Upaya Bank Dagang Bali melawan pencabutan izin usaha oleh Bank Indonesia

Penelitian ini mengenai upaya-upaya hukum yang ditempuh oleh Pemegang Saham PT. Bank Dagang Bali untuk melawan pencabutan izin usaha PT. Bank Dagang Bali oleh Gubernur Bank Indonesia, bertujuan untuk mengetahui upaya apa yang dilakukan, bagaimana hasilnya dan sejauh mana efektifitas hasil yang diperoleh. Penelitian ini termasuk penelitian hukum sosiologis normatif atau non doktrinal yang bersifat deskriptif. Hasil penelitian menunjukan upaya yang dilakukan yaitu mengajukan permohonan dan gugatan ke Pengadilan Negeri Denpasar dan Pengadilan TUN Jakarta, dengan hasil ada yang ditolak dan ada yang dikabulkan. Dengan hasil akhir bahwa Surat Keputusan Gubernur B.I. tentang Pencabutan Izin Usaha PT. Bank Dagang Bali dinyatakan batal dan harus dicabut, berdasarkan putusan Mahkamah Agung R.I. Namun, putusan tinggal putusan, fakta menunjukan sampai saat ini PT. Bank Dagang Bali tetap dalam Likuidasi.

This research observed about the legal effort that took by Bali Commerce Bank’s shareholders to against the liquidation that placed on them by the governor of Bank of Indonesia. This research aimed to found what efforts that took, what are the result, and how far was the effectiveness of the obtained results. The research included descriptive normative sociological / non-doctrinal law research. The result of this research shown the effort that took by the shareholders of Bali commerce Bank proffered a petition and lawsuit to the District Court of Denpasar and Administrative Court of Jakarta, where the petition and lawsuit had rejected and granted for each. According to the decree of the Supreme Court of Indonesia, as the final decision, the Governor of Bank of Indonesia’s Decree of Liquidation declared to be null and void. However, the decision was remain a decision, the fact show that until today the Liquidation Team still continuing their assignment to liquidate Bali Commerce Bank , Ltd.
