Penelitian tentang “Aspek Hukum terhadap Daya Tarik Penanaman Modal Asing di Bidang Hutan Tanaman Industri” dilakukan dengan tujuan mendapatkan informasi peraturan perundang-undangan yang terkait dengan penanaman modal asing di bidang hutan tanaman industri. Penelitian ini juga bertujuan untuk mengetahui kendala dan dampak penanaman modal asing di bidang hutan tanaman industri, dan untuk menemukan strategi untuk menarik investor asing menanamkan modalnya di bidang hutan tanaman industri. Penelitian ini merupakan penelitian hukum normatif yang bersifat deskriptif preskriptif dengan analisis dilakukan secara kritis. Dari penelitian ini diharapkan dapat diperoleh gambaran secara jelas mengenai pengaturan, kendala, dan dampak penanaman modal asing di bidang hutan tanaman industri, serta strategi untuk menarik investor asing menanamkan modalnya di bidang hutan tanaman industri. Data dalam penelitian ini meliputi data sekunder yang diperoleh dari studi kepustakaan dan data primer yang diperoleh melalui wawancara secara langsung dengan narasumber dan responden. Lokasi penelitian ini dilakukan di Departemen Kehutan, Badan Koordinasi Penanaman Modal, dan Asosiasi Pengusaha Hutan Indonesia yang berkantor di Jakarta. Data yang diperoleh dianalisis secara kualitatif. Dari hasil penelitian diketahui bahwa pada umumnya peraturan terkait kegiatan penanaman modal adalah Undang-Undang Nomor 25 Tahun 2007 tentang Penanaman Modal. Di bidang kehutanan, pengaturan mengenai penanaman modal asing di bidang hutan tanaman industri tercermin dari pasal-pasal yang mengatur mengenai pengelolaan hutan, khususnya pemanfaatan hutan pada hutan produksi. Iklim penanaman modal asing di bidang hutan tanaman industri belum kondusif. Hal ini disebabkan adanya kendala menyangkut kepastian hukum, kepastian usaha, dan kepastian kawasan. Adapun dampak positifnya adalah tercapainya upaya percepatan pembangunan hutan tanaman industri dan terjaminnya pemenuhan bahan baku industri, terbukanya lapangan kerja dan usaha, terserapnya tenaga kerja, dan meningkatnya devisa. Dampak negatifnya adalah kerusakan lingkungan hidup dan kelestarian hutan, ketergantungan dan dominasi asing atas sumber daya hutan, dan kemungkinan kontrol mayoritas atas perusahaan hutan tanaman industri dan industrinya. Strategi yang digunakan untuk menarik investor asing adalah menciptakan agar iklim investasi kondusif, memberikan berbagai fasilitas dan insentif, mengupayakan deregulasi dan debirokratisasi, dan perusahaan HTI yang terintegrasi dengan industrinya.

The purpose of this research on “Legal Aspect toward Power of Attraction of Foreign Direct Investment in the Field of Industrial Forest Plantation” is to obtain the information of the regulation on foreign direct investment in the field of industrial forest plantation. It is also aimed to know the obstacles and the impacts of foreign direct investment in the field of industrial forest plantation, and to find out the strategy to attract the foreign investor investing its capital in the field of industrial forest plantation. This research is a normative juridical research with the prescriptive descriptive technique using analysis critically. From this research, it is expected to be obtained a clear description on the regulations, the obstacles, the impacts, and the strategy to attract the foreign investor investing its capital in the field of industrial forest plantation. Data in this research include secondary data obtained from literature study and primary data obtained from direct interview with the informant and respondent. The location of the research is at the Ministry of Forestry, Investment Coordinating Board, and Asssociation of Indonesian Forest Concessionaires based in Jakarta. The data obtained are then analyzed qualitatively. Based on the result of the research, it is known that generally the regulation on foreign direct investment activity is the Act of Investment Number 25, 2007. In the field of industrial forest plantation, it is reflected from the articles that regulate on forest management, especially forest utilization in the production forest. The climate of foreign direct investment in the field of industrial forest plantation has not been conducive yet. It is caused by the impacts concerning legal certainty, business certainty, and area certainty. The positive impacts are the achievement of acceleration on the development industrial forest plantation and the guaranteed in the fulfillment of industrial raw material, the availability of opportunities for business and employment, manpower absorption, and the increasing of foreign exchange. The negative impacts are the damage of the environment and sustainable forest, the dependence and foreign domination of forest resources, and the possibility of majority control on the industrial forest plantation company and its factory. The strategy for attracting foreign investor is to create the climate of investment to be conducive, to give facilities and incentives, to provide deregulation and debirocration, and the integration of industrial forest plantation company with its industry.
