Peranan Direktorat Jenderal Bea dan Cukai dalam pencegahan Pembajakan Hak Cipta khususnya media cakram Optik

Penelitian ini terfokus kepada tiga permasalahan utama, yaitu: (1) Bagaimanakah peranan Direktorat Jenderal Bea dan Cukai dalam mencegah terjadinya pembajakan hak cipta khususnya media cakram optik? (2) Upaya-upaya apakah yang telah dilakukan oleh Direktorat Jenderal Bea dan Cukai dalam mencegah terjadinya pembajakan hak cipta khususnya media cakram optik? (3) Kendala-kendala apakah yang dihadapi oleh Direktorat Jenderal Bea dan Cukai dalam mencegah terjadinya pembajakan hak cipta khususnya media cakram optik? Studi ini dilakukan dengan tujuan untuk memperoleh gambaran yang jelas tentang peranan Direktorat Jenderal Bea dan Cukai dalam mencegah terjadinya pembajakan hak cipta khususnya media cakram optik, upaya-upaya yang telah dilakukan, dan untuk mengetahui kendala-kendala yang dihadapi beserta penanggulangan atau cara mengatasinya. Hasil studi ini diharapkan bermanfaat secara keilmuan berupa penambahan referensi ilmu hukum, khususnya hukum kepabeanan. Secara pragmatis pula, hasil studi ini dapat menjadi input bagi pemegang kebijakan dalam rangka rekonstruksi bahkan merancangbangun hukum kepabeanan dimasa yang akan datang (ius constituendum). Temuan studi ini menunjukan: pertama, bahwa peranan Direktorat Jenderal Bea dan Cukai dalam mencegah pembajakan hak cipta khususnya media cakram optik secara passive action procedure dan active action procedure telah diakomodir oleh UU Kepabeanan Nasional dalam kerangka GATT/WTO maupun TRIPs. Kedua, bahwa kelemahan peranan Direktorat Jenderal Bea dan Cukai dalam mencegah pembajakan hak cipta dikarenakan belum adanya aturan pelaksanaan dari UU Kepabeanan pada level Peraturan Pemerintah. Ketiga, Belum adanya pemikiran secara komprehensif di tingkat legislasi sehingga menimbulkan ketidaksinkronnya UU Kepabeanan dengan peraturan perundang-undangan sektoral. Keempat, permasalahan pada level institusional, yaitu kendala internal maupun eksternal Bea dan Cukai sebagai garda depan pelaksana UU Kepabeanan merupakan suatu permasalahan tersendiri yang membutuhkan upaya untuk pemecahannya.

The research focused on three main issues, these are: (1) How role of Directorate General of Customs and Excise in preventing the occurred of piracy-copyright particularly is optical disc media? (2) What efforts have been performed by Directorate General of Customs and Excise in preventing the occurred of piracy-copyright particularly upon optical disc media? (3) What constraints faced by Directorate General of Customs and Excise in preventing the occurred of piracy-copyright particularly upon optical disc media? The study was done aims to obtain the explicit representation about the role of Directorate General of Customs and Excise in preventing the occurred of piracy-copyright particularly upon optical disc media, the efforts have been done, and the recognize the constraints which faced along with the talking and the ways to overcome. The result of study is expected become scientifically useful in the form of jurisprudence reference additional, especially customs law. Pragmatically, the study result might be an input for the policy holder in order to reconstruction even in engineering the customs law in the future (ius constituendum). The finding of study is demonstrating: First, the role of Directorate General of Customs and Excise in preventing piracy-copyright particularly is optical disc media by both a passive and active action procedures have been accommodated by National Customs Act neither on GATT/ WTO nor TRIPs plans. Secondly, the shortcoming of the role of Directorate General of Customs and Excise in preventing piracy-copyright because of the inexistence of implementation order from Customs Act on Govermental Regulation Level. Third, the inexistence of thoughts comprehensively in the legislation level so that it was generating an asynchronous of Customs Act by Sectoral Law and Regulation. Fourth, the problems upon institutional level, those are customs internal or external constraints as the implementation front guard of Customs Act is a separate problem requiring resolving efforts.
