Perlunya perlindungan harkat dan martabat perwakilan diplomatik oleh negara penerima

Penelitian ini dilakukan untuk mengetahui pentingnya suatu perlindungan harkat dan martabat Perwakilan Diplomatik dalam suatu Hubungan Diplomatik di komunitas internasional. Penelitian ini ditekankan pada 2 permasalahan yaitu : a. Apa bentuk kewajiban negara penerima dalam menjamin perlindungan terhadap harkat dan martabat suatu perwakilan diplomatik; b. Adakah pengaruh perlindungan harkat dan martabat perwakilan diplomatik terhadap pelaksanaan fungsi suatu perwakilan diplomatik. Penelitian ini dilakukan melalui studi kepustakaan dan wawancara. Data yang terkumpul kemudian disusun secara sistematis dan dianalisis secara deduktif, induktif dan komparatif. Dari hasil penelitian diketahui bahwa : a. Perlindungan harkat dan martabat Perwakilan Diplomatik sangat erat kaitannya dengan perlindungan kekebalan dan keistimewaan Perwakilan Diplomatik. Hal ini dibuktikan bahwa kekebalan dan keistimewaan itu merupakan salah satu bentuk penghormatan atas sifat-sifat Perwakilan Diplomatik yang dianggap suci; b. Kewajiban negara penerima dalam melindungi kekebalan dan keistimewaan secara sistematis telah diatur dalam Konvensi Wina 1961 mengenai Hubungan Diplomatik. Konvensi Wina 1961 telah mengatur secara bersamaan hak dan kewajiban bagi masing-masing pihak yang terkait dalam suatu hubungan diplomatik; c. Pelaksanaan fungsi-fungsi Perwakilan Diplomatik sangat bergantung pada perlindungan harkat dan martabat Perwakilan Diplomatik.

This research was desirous to know about the importance of a protection to the Diplomatic Representative’s dignity in an international community’s diplomatic relations. This research was focused on two main problems, namely: a. what is the form of the obligation of the receiving state to ensure the protection of the diplomatic representative’s dignity; b. is there any influence of the protection to the diplomatic representative’s dignity to the application of the function of diplomatic representative. The data of the research collected through both library research and interview. After being collected, the data arranged systematically and analyzed deductively, inductively, and comparatively. Based on the output of the research, it was concluded by: a. protection to the diplomatic representative’s dignity is closely related with the protection to the immunities and privileges protection. It is proved that those immunities and privileges is one of form of the respective on the characters of the diplomatic representative; b. The obligation of the receiving state, protecting the immunities and privileges is systematically regulated in the Vienna Convention 1961 on Diplomatic Relations. This convention has regulated the right and obligation for each party which involved in a diplomatic relations; c. the application of the diplomatic representative’s functions is depend to the protection of the diplomatic representative’s dignity.
