Kendala pelaksanaan kebijakan penyediaan lahan kompensasi dalam proses pinjam pakai kawasan hutan untuk usaha pertambangan

Penelitian ini bertujuan untuk menjawab permasalahan yang menjadi kendala pelaksanaan kebijakan penyediaan lahan kompensasi dalam proses pinjam pakai kawasan hutan untuk usaha pertambangan. Penelitian ini pada prinsipnya bersifat penelitian hukum normatif untuk menganalisa peraturan perundan g-undangan maupun pendapat para ahli. Adapun jenis dari penelitian ini meliputi penelitian kepustakaan dan penelitian lapangan guna mendukung data sekunder. Penelitian dilakukan melalui 3 (tiga) tahap yaitu : tahap persiapan dengan mengumpulkan data sekunder, dilanjutkan dengan tahap pelaksanaan dimana terhadap data sekunder yang telah dikumpulkan dilakukan inventarisasi, proses wawancara kepada narasumber dan inventarisasi data yang diperoleh dari hasil wawancara, selanjutnya diakhiri dengan tahap penyelesaian yaitu penulisan laporan awal hasil penelitian dan proses analisis secara kualitatif untuk diwujudkan dalam laporan akhir yang bersifat deskriptif. Hasil dari penelitian ini adalah sebagai berikut, bahwa kendala pelaksanaan kebijakan penyediaan lahan kompensasi dalam proses pinjam pakai kawasan hutan untuk usaha pertambangan bersumber dari faktor intern al dan eksternal dari kebijakan yang bersangkutan. Kendala faktor internal : kebijakan persyaratan penyediaan lahan kompensasi dalam Permenhut P.14/2006 isinya lebih mementingkan aspek ekologis dalam melindungi kepentingan di sektor kehutanan saja dan belum dapat menjangkau kepentingan sektor pertambangan serta un implementative. Kendala faktor eksternal : muatan persyaratan lahan kompensasi dan pengganti lahan kompensasi dalam Permenhut P.14/2006, implementasinya memberatkan para pengusaha tambang, maka stakeholders kurang memberikan dukungan dan respon positif, sehingga menjadi kendala dalam pelaksanaan kebijakan yang bersangkutan .

This research aimed to examine the problems that hampering the implementation of policy of awarding compensation land in the process of borrow wearing of the forest areas for effort mining. This research was principally a normative legal study to analyze regulations of law and opinions of experts. It consisted of the bibliography study to obtain secondary data and the field study to obtain supports for secondary data. The study was divided into 3 (three) stages. First, the preparation stage, during which secondary data were collected. The next stage was the implementation in which the inventory of the collected secondary data as well as the interviewing on informants and the collection of the interview results were carried out. Finally, the third stage was closing. In this stage the report on the preliminary results of study was prepared and the descriptive-qualit ative analysis process, in the form of a final report, was started. The results of study indicated that the obstacles of implementing the policy of awarding compensation land in the process of borrow wearing of the forest areas for effort mining came from intern and extern factors. Among the intern factors was the policy of requiring compensation land under the regulation of the Minister of Forestry, P.14/2006, only putting more importance on the ecological aspects to protect forest areas but had not addressed the interests in mining sector. The extern factors that causing obstacles were associated with requirements of compensation land and substitute of compensation land as provided under the regulation of the Minister of Forestry of P.14/2006. The implementation of such requirements put heavy burdens on quarry entrepreneurs, which causing lack of support and positive response from the stakeholders, which in turn hampered the implementation of the policy itself.
