Tujuan penelitian ini adalah tujuan deskriptif yaitu untuk memperoleh gambaran pelaksanaan fungsi Unit Pelaksana Teknis pengawasan dibidang Penatausahaan Hasil Hutan, tujuan kreatif yaitu mengetahui kendala yuridis yang menghambat pelaksanaan fungsi Unit Pelaksana Teknis Pengawasan dibidang Penatausahaan Hasil Hutan dan tujuan inovatif yaitu merumuskan langkahlangkah yang harus dilakukan agar fungsi Unit Pelaksana Teknis pengawasan di bidang Penatausahaan Hasil Hutan dapat terlaksana dengan baik dalam meningkatkan ketertiban dan kelancaran Penatausahaan Hasil Hutan. Penelitian ini merupakan penelitian hukum normatif yang meliputi taraf konsistensi dan sinkronisasinya baik vertikal maupun horisontal peraturan perundang-undangan yang melandasi pelaksanaan fungsi Unit Pelaksana Teknis yang melakukan kegiatan pengawasan dibidang Penatausahaan hasil hutan. Data yang dipergunakan dalam penelitian ini adalah data sekunder yang diperoleh melalui studi pustaka, namun untuk melengkapi data sekunder dipergunakan juga data primer yang diperoleh melalui wawancara. Hasil Penelitian menunjukkan bahwa : 1. Pelaksanaan fungsi Unit Pelaksana Teknis pengawasan di bidang Penatausahaan Hasil Hutan belum dapat berjalan secara efektif sehingga belum mampu mewujudkan ketertiban dan kelancaran Penatausahaan hasil Hutan. 2. Kendala Yuridis yang menghambat Fungsi Unit Pelaksana Teknis dalam melakukan pengawasan teknis adalah pertama hambatan sistem hukum berkaitan dasar hukum kewenangan Penerbit Faktur, Tata Cara Penerbitan Dokumen dan lemahnya landasan yuridis tentang Penilaian Kinerja PHH/PPHH kedua Hambatan asas hukum berupa Asas Kejelasan Tujuan, Asas Kejelasan Rumusan, dan Asas Keadilan terkait peraturan mengenai Peraturan di bidang penatausahaan hasil hutan, Peraturan penilaian Kinerja PHH/PPHH, dan peraturan tentang Tugas Pokok dan Fungsi BPPHP ketiga Balai belum melakukan pengawasan terhadap penggunaan kewenangan Penerbit Faktur dan belum adanya peraturan mengenai mekanisme pengawasan teknis yang harus dilakukan Balai. 3. Langkah yuridis yang dapat dilakukan adalah pertama merevisi perundang-undangan yang terkait dalam dasar hukum kewenangan penerbit faktur, Tata Cara Penerbitan SKSHH, dan peraturan Penilaian Kinerja PHH/PPHH, kedua merevisi peraturan yang terkait dengan Tata Waktu Pelaporan, tugas dan tanggung jawab bagi PHH, rumusan mengenai tenaga Teknis Bina Produksi Kehutanan ketiga perlu pengaturan yang jelas tentang mekanisme pengawasan teknis dan Balai harus melakukan pengawasan secara langsung terhadap proses kerja dan hasil kerja terhadap Penerbit Faktur Kayu Bulat melalui peningkatan peran tenaga Fungsional Pengendali Ekosistem.

The aim of this research is to obtain the description of Technical Executor Unit function which is controlling of Forest Yield Administration, knowing constraints of juridical from Technical Unit Executor function which is controlling of forest yield administration and to formulate the steps which must be done by Technical Unit Executor so that improving the orderliness and fluency of Forest Yield adminitsration. This research is the law normatif research which covering the consistency level and synchronization of horizontal and vertical from basic rules of the Technical Executor Unit function which doing activity to control of the Forest Yield Administration. The Datas which utilized in this research are secondary datas that obtained from book study, however to equip of the secondary datas but also used the primary datas that are taken from interview. The results of this research are: 1. The implementation of Function of Technical Implementation in controlling of Forest Yield Adminitration is not yet earned to walk effectively so that not yet can realize orderliness and fluency of Penatausahaan result of Forest. 2. The barriers of juridical which blocking the Technical Executor Unit function which doing activity to control of the Forest Yield Administration are Firstly The barriers of law system have relation about the base of law of authorization of the Invoice Publisher, the Procedures Publication of Document and the weaknesses of juridical basis the regulation of Assesment of performance Result of Supervisor of Forest Yield Grader and Forest Yield Grader, Secondly The barriers of law principle are Clarity Of Target principle, Clarity of formula principle, and Justice principle about regulation of Forest Yield Administration, Assesment of performance of Supervisor of Forest Yield Grader and Forest Yield Grader, The regulation of Function of BPPHP Thirdly there is no access to control The Officer of Forest Yield Administration and there are no rules about the mechanism of technical control. 3. The juridical effort that should be done are Firstly revising regulation that related in the base of law of authorization of the Invoice Publisher, regulation of Assesment of performance Result of Supervisor of Forest Yield Grader and Forest Yield Grader Secondly revising regulation which related to Forest Yield Administration, Assesment of performance of Supervisor of Forest Yield Grader and Forest Yield Grader, The regulation of Function of BPPHP, Thirdly it is needed a clear arrangement concerning about a mechanism of technical control and mechanism of control about work process and result of Publisher of Invoice Log that straight in the field.
