Perkembangan Investasi di Bidang Industri Telekomunikasi Selular Kaitannya dengan Otonomi Daerah

Penelitian ini bertujuan untuk mengetahui dan memahami bentuk peraturan yang ditetapkan oleh pemerintah daerah dalam kaitannya dengan pungutan terhadap menara telekomunikasi selular dan apakah keberadaan dari peraturan yang dibentuk oleh pemerintah saat ini telah melindungi berkembangnya dunia telekomunikasi atau justru menghambat dunia telekomunikasi. Penelitian ini merupakan penelitian normative yang menggunakan bahan hukum berupa peraturan perundang-undangan, literature, pendapat para ahli dan studi kasus. Bahan hukum tersebut diharapkan dapat menjawab berbagai permasalahan yang ingin diketahui dari penelitian ini. Dari penelitian ini diperoleh hasil bahwa pungutan terhadap menara telekomunikasi telah dilakukan dan dituangkan dalam beberapa peraturan oleh pemerintah daerah. Dari beberapa contoh surat keputusan yang telah ditetapkan oleh pemerintah daerah terlihat bahwa pembentukan peraturan tersebut mempunyai beberapa kelemahan dan dapat membebani para investor telekomunikasi. Penetapan peraturan perundang-undangan di daerah sebaiknya juga memperhitungkan aspek ekonomi dan dampaknya bagi para investor.

The aim of this research is to know and understand any regulations enacted by local government relating to tax or retribution to telecommunication tower. This research also aims to know whether the existence of the regulation would protect expanding telecommunication business or hamper telecommunication world. This is a normative research which uses material laws in the form of law and regulation, literature, case study and scholar opinion. The law material can answer various problems to be known from this research. The result of this research demonstrates that tax or retribution to telecommunication tower has been laid down in some regulations. The regulations which have been enacted by local government have some weakness and can encumber telecommunication investor. This situation is caused by we do not have umbrella act regarding tax or retribution to telecommunication tower. The enactment of the regulation should take into account of economic aspects and its impact to investors.
