2007 | Tesis | S2 Ilmu Hukum (Hukum Bisnis)Penelitian ini merupakan penelitian hukum normatif, yang bertujuan untuk mengetahui penolakan SP KAHUTINDO terhadap penetapan UMSP Perkayuan dan Kehutanan tahun 2002, alasan pengusaha menyepakati PB.21 dan status hukumnya, serta peran Dewan Pengupahan Daerah Propinsi Kalimantan Timur terhadap harmonisasi hubungan industrial di Lingkup Industri Perkayuan Wilayah Kota Samarinda. Data yang dipergunakan adalah data primer dan data sekunder. Data primer diperoleh dari penelitian lapangan, di mana pengumpulan datanya diperoleh dengan mempergunakan pedoman wawancara. Sedangkan data sekunder diperoleh melalui penelitian kepustakaan dengan studi dokumen. Penelitian ini dilakukan di Lingkup Industri Perkayuan Wilayah Kota Samarinda pada tahun 2002. Subyek penelitian adalah Dewan Pengupahan Daerah Propinsi Kalimantan Timur, di samping Dinas Tenaga Kerja Kota Samarinda, BAPPEDA Propinsi Kalimantan Timur, pengurus serikat pekerja/serikat buruh tingkat propinsi, dan perusahaan industri perkayuan di wilayah Kota Samarinda, yang ditentukan secara random. Data yang diperoleh diseleksi, kemudian dianalisis secara kualitatif normatif, dan selanjutnya disusun dalam laporan penelitian yang bersifat deskriptif. Hasil penelitian menunjukkan, pertama, bahwa penolakan penetapan UMSP Perkayuan dan Kehutanan tahun 2002 oleh SP KAHUTINDO karena disebabkan adanya Persetujuan Bersama tanggal 21 Nopember 2000 (= PB.21). Kedua, pembuatan PB.21 yang disepakati lebih bersifat keterpaksaan, karena adanya tekanan massa yang digalang oleh DPD SP KAHUTINDO Kaltim. Sehingga berakibat PB.21 menjadi batal demi hukum, karena bertentangan dengan syarat obyektif pembuatan suatu perjanjian. Ketiga, peran DEPEDA harus mandiri, netral, memperhatikan saran/- masukan dari pihak lain, dan mentaati tata tertib yang telah disepakati.
This is normative legal study aimed at investigating the refusal of SP KAHUTINDO on Provincial Sectoral Minimum Wage (UMSP) in the areas of Wood and Forestry industries in the year 2002, the entrepreneur’s reasons on agreeing the Collective Agreement 21 (PB.21) and its legal status, and the role of Regional Remuneration Boards of East Kalimantan Province in harmonizing the industrial relations in the area of wood industry at Samarinda Municipality. The data collected was both primary and secondary. The primary data collected from field study by means of interviews, whereas the secondary data was obtained from documentary and literature studies. The study was carried out in the area of Wood Industry at Samarinda Municipality in the year 2002. The subject of the study were the Regional Remuneration Boards of East Kalimantan Province, in addition to the Manpower Office Service Samarinda Municipality, the Regional Develop-ment Planning Boards (BAPPEDA) of East Kalimantan Province, the Executives of Provincial Labor Organization, and companies of wood industry in Samarinda Municipality, where the data was taken randomly. Then the collected data was selected and qualitatively and normatively analyzed, and finally the findings of the study were put into a descriptive research report. This results of the study showed, firstly, that the refusal of the Provincial Sectoral Minimum Wages (UMSP) in the areas of wood and forestry industries in the year 2002 by SP KAHUTINDO was due to the fact that there was Collective Agreement dated on 21th November 2000, which was known as “PB.21â€. Secondly, the PB.21 was agreed under the pressure of mass organized by Regional Labor Organization Executives (DPD SP KAHUTINDO), East Kalimantan. As a results, “PB.21†was legally null and void, just because it was against the objective requirements of an agreement. Thirdly, the role of the Regional Council Executives (DEPEDA) had to be independent, neutral, taking into consideration the suggestion/inputs from others parties and had to abide by the agreed rules and regulations.
