Pengaturan Perlindungan Hukum bagi Pekerja Rumah Tangga dalam UU NO.13 Tahun 2003 tentang Ketenagakerjaan

Penelitian ini bertujuan untuk mengetahui kedudukan hukum pekerja rumah tangga di dalam UU No. 13 Tahun 2003. Mengetahui pengaturan perlindungan hukum terhadap PRT menurut UU No. 13 Tahun 2003 dan penerapan perlindungan hukum bagi PRT tersebut. Penelitian ini menggunakan pendekatan yuridis normatif. Pendekatan yuridis normatif digunakan dengan maksud untuk membahas objek yang hendak diteliti berupa peraturan perundang-undangan, perjanjian, yurisprudensi, yang berkaitan dengan masalah perlindungan hukum bagi pekerja rumah tangga. Hasil penelitian ini adalah sebagai berikut : A. didalam UU No. 13 Tahun 2003 tersebut dengan sangat jelas PRT termasuk dalam kategori pekerja sehingga sudah seharusnya jika PRT juga diatur lebih lanjut oleh UU tersebut. B. Di dalam UU ini sebenarnya terdapat juga pasal-pasal yang memberikan perlindungan hukum terhadap pekerja secara menyeluruh, sehingga PRT juga termasuk di dalamnya. Namun perlindungan hukum tersebut hanya merupakan himbauan belaka tanpa ada sanksi yang jelas jika terjadi pelanggaran. C. Walaupun dalam UU Nomor 13 Tahun 2003 tentang Ketenagakerjaan tersebut terdapat pasal-pasal yang pada dasarnya memberikan perlindungan hukum bagi PRT namun tidak dapat diterapkan karena tidak disertai sanksi-sanksi yang jelas.

The research aims to find out legal status of housekeeper in Law No. 13 of 2003. To find out arrangement of law protection for domestic worker in law no.13 of 2003 regarding matters pertaining to manpower. This study used normative juridical approach. Normative juridical approach was used aiming to discuss the objects going to be observed in the form of regulation, agreement, jurisprudence, related to law protection for housekeeper. The results of this research are as follows: A. In Law No. 13 of 2003 become clear that housekeeper included in worker category so that have ought to if housekeeper also arranged furthermore by the Act. B. In this Act actually in fact there are also article giving law protection to worker by totally, so that housekeeper also the inclusive of in it. But the law protection only represent the mere urge without there is clear sanction if happened by collision. C. Although in Law Number 13 of 2003 regarding Matters Pertaining To Manpower there are articles which basically give the protection of law for housekeeper but cannot be applied because not accompanied by the clear sanction
