Peranan Direktorat Jenderal Bea dan Cukai dalam menangani minuman mengandung etil alkohol impor yang ilegal

Tujuan penelitian ini untuk memperoleh gambaran yang jelas tentang upaya yang telah dilakukan Direktorat Jenderal Bea dan Cukai serta kendalakendala yang dihadapi dalam menangani minuman mengandung etil alkohol impor yang ilegal. Penelitian ini merupakan penelitian hukum empiris, yaitu penelitian yang mengutamakan penelitian lapangan untuk memperoleh data primer, dan untuk menunjang dan melengkapi data, maka dilakukan juga penelitian kepustakaan untuk memperoleh data sekunder. Seluruh data dari penelitian ini dianalisis secara deskriptif kualitatif. Hasil penelitian ini adalah : (1) Direktorat Jenderal Bea dan Cukai belum berupaya optimal dalam menangani masalah yang timbul dari minuman mengandung etil alkohol impor yang illegal, sehingga regulered function ini belum diperankan dengan sepenuhnya oleh Direktorat Jenderal Bea dan Cukai, (2) dalam pelaksanaannya di lapangan, ditemui berbagai macam kendala seperti faktor geografis wilayah perairan Indonesia, faktor biaya operasional, dan kurangnya personil aparat Bea dan Cukai yang memiliki skill dan komitmen.

The objective of the research is obtain to a description about the efforts of the customs office general director as well as distractions faced in handling the illegal import ot the alcoholic drink The reseach is an empirical research, that is focusing in field research to get the primary data and to support and complete secondary data from library research. The entire data of the research are analyzed qualitatively and descriptively. The research result were : (1) the customs office general director not efforts yet to handle the problem caused by illegal import of the alcoholic drink, so that the regulered function is not roled by the customs office general director fully, (2) in the field implementation, there were several distraction such as the the geographical factor of Indonesian territorial waters, the operational fee, and the un availa ble personnel of the customs office general director having skill and commitment.
