Tinjauan hukum terhadap pelaksanaan Outsourcing sumber daya manusia di PT (Persero) Angkasa Pura II

2005 | Tesis | Magister ManajemenFenomena mengalih-dayakan sebagian kegiatan operasional dan manajemen kepada pihak ketiga, atau lebih dikenal dengan istilah outsourcing, saat ini sedang menjadi trend dalam kegiatan pengelolaan perusahaan. Kegiatan tersebut dilakukan dan menjadi salah satu strategi pengelolaan perusahaan antara lain dengan alasan ; fokus pada core business, efisiensi biaya, transfer teknologi, mengalihkan sebagian resiko dan lain-lain. Cikal bakal perkembangan kegiatan outsourcing di Indonesia dimulai seiring dengan berkembangnya pengelolaan minyak dan gas bumi (MIGAS), yaitu dengan diundangkannya Undang Undang Nomor 40/Prp Tahun 1960 tentang Pertambangan Minyak dan Gas Bumi. Selanjutnya dalam perkembangannya Pemerintah mengatur pengalihan sebagian kegiatan pengadaan barang/jasa dalam Pedoman Pelaksanaan Pengadaan Barang/Jasa Pemerintah (Keputusan Presiden Nomor 18 Tahun 2000 sebagaimana telah diubah dengan Keputusan Presiden Nomor 80 Tahun 2003). Khusus terkait dengan kegiatan outsourcing sumber daya manusia, saat ini hal tersebut telah diatur di dalam Undang Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan. Kegiatan outsourcing di PT (Persero) Angkasa Pura II juga telah dilakukan sejak lama, khususnya terhadap pekerjaan-pekerjaan pemeliharaan. Saat ini, khusus terkait dengan outsourcing sumber daya manusia, berdasarkan laporan unit Human Resouces Development, di PT (Persero) Angkasa Pura II tercatat sejumlah 981 orang tenaga outsourcing, belum termasuk tenaga kerja untuk pekerjaan pemeliharaan yang dilaksanakan dengan perjanjian pemborongan. Sehubungan dengan hal tersebut, terdapat hal-hal yang perlu diwaspadai oleh PT (Persero) Angkasa Pura II di dalam pelaksanaan outsourcing tenaga kerja, yaitu kemungkinan timbulnya tuntutan dari para pekerja penyedia jasa outsourcing kepada PT (Persero) Angkasa Pura II sehubungan dengan hubungan kerja. PT (Persero) Angkasa Pura II dapat terkena tanggung-jawab renteng atas perselisihan ketenagakerjaan yang terjadi antara pekerja dengan penyedia jasa.
Transferring a particular operations and management activities to the third party, or well-known as outsourcing, at this present time is becoming a tendency in managing business. The reason outsourcing has been taken as one of business strategy, is to focusing on core-business, cost efficiency, technology transfer, and also risk-transfer, etc. Along with the development of organizing the usage of oil and earth-gas (MIGAS) which has been regulated in Law Number 40/Prp Year 1960 about Pertambangan Minyak dan Gas Bumi, outsourcing is starting to be known as well. In progress, The Government has formally managed the transferring some activities of the procurement of goods and services into The Procedure of The Procurement of Goods and Services (President Decree Number 18 Year 2000 that has revised with President Decree Number 80 Year 2003). Concerning outsourcing of Human Resources, at the moment this matter has been formally regulated with Law Number 13 Year 2003 about Man Power. PT (Persero) Angkasa Pura II actually has already performed outsourcing of human resources quite long time, specially for maintenance works. Now, related to outsourcing of human resources, based on The Report of Human Resources Development Directorate year 2005, there are 981 workers legally contracted with outsourcing in PT (Persero) Angkasa Pura II, not included workers for maintenance works which also has been contracted. Regarding to the matter above, it should be awared and predicted by PT (Persero) Angkasa Pura II that outsourcing of human resources would have probability raising any demand from the workers of the agency of human resources to (Persero) Angkasa Pura II could have propotional liability in case of any dispute between the agency and their workers.
