Pemilihan Presiden dan Wakil Presiden menurut Undang-undang Dasar 1945 dalam konteks pelaksanaan asas Demokrasi

Tujuan penelitian ini adalah untuk mencari dan mengetahui bagaimana prosedur pemilihan Presiden dan Wakil Presiden Republik Indonesia menurut Undang Undang Dasar Tahun 1945 dalam kaitannya dengan penegakaan asas demokrasi. Untuk itu diteliti bagaimana prosedur pemilihan Presiden dan Wakil Presiden oleh PPKI, oleh MPRS dan MPR serta oleh Rakyat secara langsung dan kaitannya dengan penegakan asas demokrasi di Indonesia. Penelitian dilakukan dengan cara penelitian kepustakaan dimulai dengan mengumpulkan dan mengkaji bahan bahan hukum primer, sekunder dan tertier. Setelah itu dilakukan analisa data dan menulis laporan awal, dikonsultasikan dengan dosen pembimbing dan diakhiri dengan penyusunan laporan secara lengkap. Untuk itu dilakukan pengumpulan data yang meliputi prosedur pemilihan umum Presiden dan Wakil Presiden oleh PPKI, MPRS, MPR dan oleh rakyat secara langsung. Dari penelitian tersebut diperoleh hasil bahwa prosedur pemilihan Presiden dan Wakil Presiden Republik Indonesia ternyata sangat menentukan bagi upaya penegakan asas demokrasi. Prosedur pemilihan Presiden dan Wakil Presiden oleh rakyat secara langsung pada tahun 2004 telah mampu meningkatkan penegakan asas demokrasi. Atau paling tidak lebih demokratis dibanding dengan prosedur pemilihan Presiden dan Wakil Presiden oleh PPKI, MPRS dan MPR.

The object of this research is to seek and describe the procedure of election of President and Vice President of Republic of Indonesia according to Undang Undang Dasar Tahun 1945 related to the improvement of democracy principle. For this purpose, this research has taken to find the election procedure of Indonesian President and Vice President by PPKI, MPR, MPRS and by the People directly. The research is prepared by collecting and analysing basis of primary, secondary and tertiary law. The next step is analysing data and making a pre report, consulting it with the lecturer and making a report completly. According with the purpose, this research has examine carefully the procedure of election of President and Vice President by PPKI, MPRS, MPR and People directly and compare each other how the procedure influence the implementation of democracy principles. The result of the research is explaining that the procedure of election of President and Vice President of Republic Indonesia had influence to the implementation of democracy principle. In faculty the election procedure of President and The Vise President by the people directly has influence very significant to the implementation of democracy principle. Or, at least it’s better than election procedure of President and Vise President by PPKI, MPRS, and MPR.
