Regulasi dan penegakannya di bidang pelayanan kesehatan dasar di Kota Gorontalo

Latar Belakang: Sejak diberlakukannya Undang-undang otonomi daerah, salah satu urusan wajib yang menjadi kewenangan pemerintah daerah kabupaten/kota antara lain adalah urusan penanganan regulasi di bidang kesehatan. Kewenangan untuk menjalankan urusan wajib tersebut termasuk upaya menjalankan fungsi regulasi khususnya di bidang pelayanan kesehatan dasar. Pelaksanaan regulasi dalam bidang pelayanan kesehatan dasar di Kota Gorontalo perlu dilihat apakah dilaksanakan dengan baik dan bagaimana penegakannya, serta siapa yang berkompeten melaksanakannya. Baik tidaknya penerapan regulasi, sangat ditentukan oleh sistem regulasi yang dibangun, baik dalam skala nasional maupun dalam skala daerah. Metode: Penelitian ini adalah menggunakan jenis penelitian studi kasus dengan rancangan kasus tunggal holistik. Subyek penelitian adalah, Telaah Dokumen Peraturan perundang-undangan Kesehatan untuk bidang pelayanan kesehatan dasar baik nasional maupun daerah, Sub Bidang Farmasi Makanan Dinas kesehatan Kota Gorontalo, Para Ketua Organisasi Profesi Kesehatan (IDI, IBI, PPNI, dan ISFI) dan pihak PT.ASKES Kota Gorontalo masing-masing 1 orang. Metode pengumpulan data adalah melalui telaah dokumen himpunan peraturan kesehatan dan wawancara sebagai konfirmasi dari telaah dokumen. Isi setiap Bab/Pasal peraturan perundang-undangan dipakai sebagai acuan untuk mengidentifikasi variabel regulasi dan konfirmasi wawancara digunakan untuk melihat sejauh mana penerapan dan penegakan regulasi. Hasil: Hasil penelitian ini mengindikasikan bahwa setiap regulasi nasional di bidang pelayanan kesehatan dasar, mencakup beberapa variabel regulasi sekaligus. Untuk regulasi daerah belum mencakup regulasi tenaga profesi, dan untuk sarana hanya mencakup variabel price atau penetapan retribusi pelayanan. Penegakan regulasi pelayanan kesehatan dasar di Kota gorontalo masih terfokus pada sarana apotik dan profesi medis. Kesimpulan: Regulasi nasional (Undang-undang dan PP) di bidang pelayanan kesehatan dasar tidak mengatur variabel regulasi secara spesifik. Penerapan regulasi tersebut di daerah belum terkoordinasi dalam satu sistem regulasi.

Background: Since Regional Autonomy Act was implemented, one of obligatory businesses of regency/municipality government is to handle the health regulation. The authority to conduct the obligatory business includes the efforts to implement the regulation especially on basic health services. It is important to observe how the regulation on bas ic health services in Gorontalo City is implemented and who are the competent implementers. Whether the regulation implementation is good or not depends on the system of the existing regulation, both regionally and nationally. Methods: This research employs case study with holistic single case design. The research subjects are documents of regional and national regulations on health legislation, Food and Pharmacy Sub-Department of Gorontalo City Health Department, the head of health profession organizations (IDI, IBI, PPNI, ISFI), and the head of PT ASKES (Health Insurance) Gorontalo City. The methods employed were documentary research and interview (which was used to confirm the documentary research). Each article/chapter of the legislation was used as reference in identifying variable of regulation. Interview was conducted to examine how far was the implementation and enforcement of the regulation. Result: The result of this research indicates that national regulation on basic health services covers several variables of regulation altogether. However, the regional regulation does not cover regulation concerning professional human resources and the infrastructure only covers Price Variable or the enactment of health retribution. The enforcement on the basic health services regulation remains focusing only on medical profession and pharmacy. Conclusion: National regulation on basic health services does not specifically include the variable of regulation. Its implementation in the area is not coordinated in one system of regulation.
