Fenomena operasi transeksual dalam perspektivitas hukum Islam

Penelitian mengenai Fenomena Operasi Transeksual Dalam Perspektivitas Hukum Islam merupakan penelitian normatif. Penelitian ini dilakukan dengan tujuan untuk mengetahui gejala yang tampak pada masyarakat, bahwa maraknya keinginan dikalangan kaum waria untuk melakukan operasi transeksual, yaitu mengganti alat kelaminnya yang asli dengan yang baru dan orang khuntsa tentang operasi penegasan kelaminnya. Kedua operasi tersebut akan dianalisa dalam kaca mata hukum Islam, tidak saja mengenai halal haram yang dihasilkan dari ijtihad ulama, tetapi lebih jauh dari itu tentang akibat hukum setelah terjadinya operasi, yaitu kedudukan waris yang bersangkutan sebagai ahli waris. Data yang dipergunakan dalam penelitian ini, adalah data primer yang diperoleh langsung dari responden dan nara sumber dengan menggunakan alat pengumpulan data berupa pedoman wawancara dan data sekunder yang diperoleh dari bahan-bahan pustaka melalui studi dokumen. Data yang telah dikumpulkan dianalisis secara kualitatif dan dibuat dalam bentuk laporan hasil penelitian yang bersifat deskriptif. Berdasarkan hasil penelitian diketahui bahwa, operasi transeksual dan operasi lainnya dengan tujuan untuk mengubah ciptaan Allah SWT, dengan motivasi untuk mempercantik diri atau untuk kenikmatan, hukumnya adalah haram. Adapun status hukum waria yang telah melakukan operasi transeksual tetap dengan identitas kelamin sebelum operasi, dalam kaitannya sebagai ahli waris, sedangkan untuk khuntsa, operasi normalisasi hukumnya mubah atau boleh. Adapun bagian khuntsa sebagai ahli waris adalah bagian yang terkecil dari dua perkiraan laki-laki dan perempuan, sesuai dengan pendapat Madzhab Imam Hanafiah.

This is a juridical, emperical research on the Phenomena of Transexual Surgery in The Perspective of Islamic Law, which is conducted purposefully to identify the obvious symptoms in the society where there is increasing eagerness among transvestites to have Transexual operation to change his/her sex from the original state to a new one and khuntsa (hermaphroditic) with the surgical confirmation on his/her sex. Both surgeries will be analyzed from Shariah point of view, not only concerning the halal-haram aspects (the lawful and the prohibited) resulted from ijtihad (concerted efforts to interpret and produce law) by ulama (Islamic scholars), but also furthering on the legal consequences after the surgeries, i.e. his/her status in inheritance as heir. Throughout this research, we use primary data -which is obtained directly from respondents and resource persons with data gathering tools such as interviews- and secondary data obtained from literatures through studies on documents. The gathered data is analyzed qualitatively and the result of this research is written in the form of descriptive report. According to the outcome of this research, we found out that Transexual surgery and other operations with the purpose of changing Allah Swt creation -motivated by eagerness to beautify oneself or for personal pleasures- is haram/prohibited. On the other hand, the legality of transvestites who have undergone operation to preserve their sex identity as before the operation and also for the khuntsa with normalization surgery, regarding to the position as heirs, is mubah (allowed). Khuntsa portion as heir to the legacy is the smallest portion from two estimations of man and woman, based on the school or madzhab of Imam Abu Hanifah.
