Penelitian ini menganalisis apakah putusan lembaga etik
dapat menjadi objek sengketa di PTUN. Lebih lanjut, penelitian ini mengkaji
apakah praktik PTUN dalam menguji putusan MKMK dapat dibenarkan serta bagaimana
praktik tersebut berimplikasi terhadap lanskap pengujian administrasi di PTUN
serta penegakan etik Mahkamah Konstitusi secara sistemik
Metode penelitian hukum normatif ini menggunakan tiga
pendekatan, yaitu pendekatan undang-undang (statute approach), pendekatan kasus
(case approach), dan pendekatan konsep (conceptual approach).
Hasil penelitian ini menyimpulkan dua hal. Pertama, PTUN
dapat menguji putusan lembaga etik, tetapi tidak semua putusan etik dapat
menjadi objek sengketa di PTUN. Putusan etik yang berada dalam ruang lingkup
administrasi pemerintahan dan bersifat final, seperti putusan KKEP, Majelis Etik KPK, MKH, MKD, dan DKPP, dapat diuji secara langsung. Sementara itu, putusan
yang berada dalam ruang lingkup administrasi pemerintahan namun hanya bersifat
rekomendasi, seperti putusan MKMK dan KY, hanya dapat diuji secara tidak langsung
melalui keputusan pejabat pemerintahan yang menindaklanjutinya. Adapun putusan
lembaga etik yang berada di luar fungsi administrasi pemerintahan, seperti
Dewan Pers, tidak dapat menjadi objek sengketa PTUN. Kewenangan PTUN, secara
normatif, terbatas pada aspek prosedur, dan substansi hukum yang berkaitan
dengan keabsahan keputusan. PTUN tidak berwenang untuk menguji ulang substansi
pelanggaran etik.
Kedua, berdasarkan analisis terhadap Putusan PTUN in casu,
dapat disimpulkan bahwa pendapat PTUN yang menyatakan bahwa Putusan MKMK dapat
diuji secara langsung merupakan hal yang tidak tepat apabila diletakkan dalam
konstruksi kewenangan PTUN serta karakter kelembagaan dan sifat Putusan MKMK.
Selain itu, putusan in casu juga menunjukkan perluasan kompetensi teknis yang
tidak tepat. PTUN dalam putusan in casu melangkah jauh hingga menilai kembali
substansi pelanggaran etik. Meskipun PTUN dalam perkara tersebut tidak secara
langsung menentukan apakah pelanggaran etik benar-benar terjadi, pembatalan
atau penganuliran sanksi etik yang ditetapkan MKMK pada hakikatnya telah
memasuki substansi penilaian etik. Dengan demikian, Putusan PTUN in casu
menunjukkan adanya persoalan batas kompetensi PTUN dalam menguji putusan
lembaga etik, yang berimplikasi terhadap konstruksi pengujian keputusan
administrasi sekaligus desain penegakan etik di lingkungan Mahkamah Konstitusi
This research examines whether decisions of ethics bodies may constitute objects of dispute before the PTUN. Furthermore, this research examines whether the PTUN's practice of reviewing MKMK’s decision can be legally and theoretically justified. This normative legal research method employs three approaches: the statute, case, and conceptual approaches.
The results of this research lead to two conclusions. First, the PTUN has jurisdiction to review decisions of ethics bodies; however, not all ethics decisions may constitute objects of dispute before the PTUN. Ethics decisions within the scope of governmental administration and are final in nature, such as decisions of the KKEP, the KPK Ethics Council, MKH, the MKD, and DKPP, may be directly reviewed before the PTUN. Decisions within the scope of governmental administration that are merely recommendatory, such as MKMK’s and KY’s decisions, may be reviewed only indirectly through an administrative decision that implements them. Ethical decisions outside the governmental administrative function, such as Dewan Pers’s decision, do not constitute objects of dispute before the PTUN. Normatively, the PTUN's jurisdiction is limited to reviewing procedural aspects and legal substance that relate to the validity of an administrative decision. The PTUN lacks jurisdiction to reconsider the substance of the underlying ethical violation.
Second, based on the analysis of the PTUN’s decision in this case, the PTUN's view that the MKMK’s decision may be directly reviewed is not appropriate when considered within the framework of the PTUN's jurisdiction. Furthermore, the PTUN’s decision in this case demonstrates an inappropriate expansion of its technical competence. In that decision, the PTUN even reassessed the substance of the alleged ethical violation. Although the PTUN did not directly determine whether an ethical violation had in fact occurred, the annulment or invalidation of the MKMK's ethical sanction, in substance, constituted an examination of the merits of the ethical assessment. Accordingly, the PTUN’s decision reveals a problem concerning the limits of the PTUN's competence in reviewing decisions of ethics bodies, with implications for both the construction of judicial review of administrative decisions and the institutional design of ethical enforcement within the MK
