Peranan Dinas Perindustrian Propinsi Kalimantan Timur dalam pembinaan sektor industri melalui penerbitan surat keterangan asal

Penelitian mengenai Peranan Dinas Perindustrian, Perdagangan Dan Koperasi Propinsi Kalimantan Timur Dalam Pembinaan Sektor Industri Melalui Penerbitan Surat Keterangan Asal merupakan penelitian yuridis normatif. Penelitian ini bertujuan untuk mengetahui peranan Dinas Perindustrian, Perdagangan Dan Koperasi Propinsi Kalimantan Timur dalam pembinaan sektor industri melalui penerbitan Surat Keterangan Asal dan faktor-faktor yang menyebabkan munculnya permintaan Surat Keterangan Asal diluar prosedur yang berlaku. Penelitian dilakukan di wilayah Propinsi Kalimantan Timur dengan mengambil sampel pejabat Dinas Perindustrian, Perdagangan Dan Koperasi Propinsi Kalimantan Timur dan 12 pelaku usaha sektor industri. Penentuan sampel dilakukan secara purposive. Hasil penelitian menunjukkan bahwa secara periodik Dinas Perindustrian, Perdagangan dan Koperasi mengumpulkan data mengenai kapasitas produksi eksportir dan mencocokkan dengan Surat Keterangan Asal yang diterbitkan. Hasil pencocokan yang diperoleh akan menentukan langkah-langkah yang diperlukan untuk melakukan pembinaan. Hasil penelitian juga menunjukkan bahwa posisi tawar eksportir relatif lemah dibanding importir sehingga eksportir cenderung mengikuti keinginan importir. Dari hasil penelitian dapat disimpulkan bahwa Dinas Perindustrian, Perdagangan Dan Koperasi dapat melakukan pembinaan dengan cara menekankan berlakunya tertib niaga melalui penerbitan Surat Keterangan Asal dan penundaan pembayaran serta upaya menekan harga merupakan faktor-faktor yang menyebabkan munculnya permintaan Surat Keterangan Asal diluar prosedur yang berlaku.

The research on the roles of Industry, Trade and Cooperative Agency of East Kalimantan province in managing industrial sectors through the issuance of letter of origin was normative judicial in nature. It aimed at discovering the roles of the Agency in leading the industrial sectors through the above mentioned method. Origins and factors which generated the requests for Letter of Origin (Surat Keterangan Asal) were beyond the prevailing procedure. The research was conducted in the areas of East Kalimantan province by taking samples of officials of the Agency and 12 entrepreneurs in industrial sectors. Samples were decided purposively. The results of research showed that continually the Industry, Trade and Cooperative Agency collected data regarding the producing capacities of exporters and matching them with the issued Letters of Origin. The results of matching gained would determine the steps taken to the management. The results also showed that bargaining positions of exporters were relatively weak in comparison with importer so that the former groups tend to fulfill the demand of the latter. From the results of research, it can be concluded that Industry, Trade and Cooperative Agency can conduct management by imposing business etiquette (tertib niaga) through the issuance of Letter of Origin and postponing the payment as well as reducing the prices; all these being factors that created the requests for Letter of Origin outside the governing procedure.
