Penelitian ini berjudul “Evaluasi Putusan Tindak Pidana Korupsi pada Proyek Konstruksi Pemerintah Pasca Terbit Peraturan Presiden Nomor 16 Tahun 2018 tentang Pengadaan Barang/Jasa Pemerintah.” Penelitian ini dilatarbelakangi oleh munculnya perkara tindak pidana korupsi pada proyek konstruksi pemerintah yang tidak hanya berkaitan dengan kerugian keuangan negara, tetapi juga dengan pembacaan terhadap tanggung jawab teknis, administratif, dan kontraktual para pihak.
Rumusan masalah dalam penelitian ini adalah apa saja bentuk permasalahan dalam putusan tindak pidana korupsi proyek konstruksi pemerintah dan bagaimana dasar pertimbangan Majelis Hakim dalam menempatkan tanggung jawab para pihak pasca terbitnya Peraturan Presiden Nomor 16 Tahun 2018. Tujuan penelitian ini adalah mengidentifikasi bentuk permasalahan dalam putusan serta mengevaluasi dasar pertimbangan Majelis Hakim dalam menempatkan tanggung jawab para pihak. Penelitian ini menggunakan metode kualitatif dengan pendekatan kepustakaan dan analisis dokumen. Data utama berupa lima putusan pengadilan yang diperoleh dari Direktori Putusan Mahkamah Agung Republik Indonesia, sedangkan data pendukung berupa peraturan perundang-undangan, pedoman pengadaan, standar kontrak konstruksi, dan literatur ilmiah. Teknik analisis data dilakukan secara deskriptif-analitis dengan menelaah kronologi perkara, fakta persidangan, bentuk permasalahan, peran para pihak, dan pertimbangan hakim, kemudian membandingkannya dengan kerangka regulasi pengadaan dan prinsip kontrak konstruksi.
Hasil penelitian menunjukkan bahwa bentuk permasalahan meliputi kekurangan volume pekerjaan, ketidaksesuaian spesifikasi teknis, penugasan tenaga pengawas tanpa pemenuhan persyaratan kompetensi, perbedaan laporan progres pekerjaan dengan kondisi faktual, serta ketidaksesuaian pencairan termin dengan progres riil pekerjaan. Kesimpulan penelitian menunjukkan bahwa pertimbangan Majelis Hakim pada perkara kontraktor dan konsultan pengawas relatif telah sesuai dengan tanggung jawab masing-masing, sedangkan pada perkara Pejabat Pembuat Komitmen masih terdapat kecenderungan membebankan akibat teknis pekerjaan ke dalam tanggung jawab administratif, meskipun Peraturan Presiden Nomor 16 Tahun 2018 telah mengubah kedudukan PPK.
This thesis, entitled “Evaluation of Court Decisions on Corruption Offenses in Government Construction Projects Following the Enactment of Presidential Regulation Number 16 of 2018 on Government Procurement of Goods/Services,” is motivated by corruption cases in government construction projects that are not only related to state financial losses, but also to the interpretation of technical, administrative, and contractual responsibilities among the parties involved. The research problems addressed in this study concern the forms of problems identified in court decisions on corruption offenses in government construction projects and the legal considerations used by judges in assigning responsibility to the parties following the enactment of Presidential Regulation Number 16 of 2018. This study aims to identify the forms of problems in the analyzed decisions and to evaluate the judges’ legal considerations in determining the responsibilities of the parties.
This research employs a qualitative method using a literature study and document analysis approach. The primary data consist of five court decisions obtained from the Directory of Decisions of the Supreme Court of the Republic of Indonesia, while the supporting data include laws and regulations, procurement guidelines, construction contract standards, and relevant academic literature. The data were analyzed descriptively and analytically by examining the case chronology, trial facts, forms of problems, roles of the parties, and judicial considerations, which were then compared with the regulatory framework of government procurement and the principles of construction contracts.
The findings show that the problems identified in the analyzed cases include work volume deficiencies, non-compliance with technical specifications, assignment of supervising personnel without the required competencies, discrepancies between progress reports and actual field conditions, and payment disbursements that did not correspond to actual work progress. The study concludes that the judges’ considerations in cases involving contractors and supervising consultants were relatively consistent with their respective responsibilities. However, in cases involving Commitment-Making Officials, the judges still tended to attribute the technical consequences of construction work to administrative responsibility, although Presidential Regulation Number 16 of 2018 has redefined the position of the Commitment-Making Official.
