Fisibilitas Pengujian Formil Putusan Mahkamah Konstitusi Yang Bertentangan Dengan Hukum Acara Mahkamah Konstitusi

Mahkamah Konstitusi (MK) didesain sebagai peradilan pada tingkat pertama dan terakhir yang putusannya bersifat final, sehingga putusannya langsung berkekuatan hukum tetap dan tidak tersedia upaya hukum apapun. Namun, dalam perkembangannya terdapat putusan yang cacat prosedural karena bertentangan dengan hukum acara yang berlaku. Penelitian ini bertujuan untuk: Pertama, mengetahui mekanisme hukum yang tersedia serta keterbatasannya terhadap putusan MK yang bertentangan dengan hukum acara MK. Kedua, mengetahui fisibilitas pengujian formil putusan MK yang bertentangan dengan hukum acara MK. Penelitian ini merupakan penelitian hukum normatif dengan pendekatan perundang-undangan, konseptual, dan kasus. Data yang telah diperoleh kemudian dianalisis secara deskriptif-kualitatif. Hasil penelitian yang diperoleh yakni: Pertama, mekanisme hukum yang tersedia yaitu pengujian kembali secara materiil maupun formil serta laporan pelanggaran etik kepada MKMK. Masing-masing mekanisme hukum tersebut memiliki keterbatasan. Pengujian kembali secara materiil hanya menjangkau aspek substantif; pengujian kembali secara formil tidak memiliki dasar hukum yang jelas dan belum dikenal dalam sistem hukum Indonesia, sementara MKMK hanya berwenang memeriksa pelanggaran etika dan putusannya tidak memiliki konsekuensi apapun terhadap suatu putusan MK. Kedua, fisibilitas pengujian formil putusan MK yang bertentangan dengan hukum acara MK dibangun melalui tiga argumentasi. Pertama, tindakan ekstra konstitusional sebagai landasan teoritis. Pengujian formil Putusan Mahkamah Konstitusi didasarkan pada tindakan ekstra konstitusional yang dapat dijustifikasi oleh adanya kebuntuan konstitusional dan kedaruratan. Praktik ini dilegitimasi oleh aspek non hukum, yaitu legitimasi etis dan legitimasi sosial. Kedua, pembatasan tindakan ekstra konstitusional pengujian formil putusan MK. Pembatasan tersebut antara lain yaitu harus terpenuhinya kondisi kedaruratan dan ruang lingkup pemeriksaan terbatas pada aspek formil prosedural putusan. Ketiga, operasionalisasi pengujian formil putusan Mahkamah Konstitusi. Pemohon yang memiliki legal standing adalah entitas yang disebutkan dalam Pasal 51 ayat (1) UU MK yang dapat menunjukkan keterkaitan langsung antara dirinya dengan norma yang lahir dari putusan Mahkamah Konstitusi yang dipersoalkan. Batu uji yang digunakan adalah ketentuan-ketentuan yang mengatur prosedur yudisial yang meliputi pengajuan permohonan, pemeriksaan persidangan, pengambilan putusan, serta asas-asas hukum acara yang diatur baik dalam UU MK, UU Kekuasaan Kehakiman, serta Peraturan Mahkamah Konstitusi.

The Constitutional Court (Mahkamah Konstitusi/MK) is designed as a court of first and final instance whose decisions are final in nature, such that its rulings acquire binding legal force immediately and are not subject to any further legal remedy. In its development, however, there have been decisions that are procedurally flawed for contravening the applicable MK procedural law. This research aims: first, to identify the legal mechanisms available and their limitations-for addressing MK decisions that contravene MK procedural law; and second, to examine the feasibility of formal review of MK decisions that contravene MK procedural law. This research is normative legal research employing statutory, conceptual, and case approaches. The data obtained were then analyzed descriptively-qualitatively. The findings of this research are as follows. First, the available legal mechanisms consist of re-review, whether material or formal, as well as the reporting of ethical violations to the Constitutional Court Honorary Council (Majelis Kehormatan Mahkamah Konstitusi/MKMK). Each of these legal mechanisms has its own limitations. Material re-review reaches only the substantive aspects of a decision; formal re-review lacks a clear legal basis and has not yet been recognized within the Indonesian legal system; while the MKMK is authorized only to examine ethical violations, and its decisions carry no consequences whatsoever for the validity of an MK ruling. Second, the feasibility of formal review of MK decisions that contravene MK procedural law is constructed through three lines of argument. First, extra-constitutional action serves as the theoretical foundation: formal review of Constitutional Court decisions is grounded in extra-constitutional action, which may be justified by the presence of constitutional deadlock and exigency. This practice is legitimized by non-legal considerations, namely ethical legitimacy and social legitimacy. Second, limitations on the extra-constitutional action of formal review of MK decisions include the requirement that conditions of exigency be met and that the scope of examination be confined to the formal-procedural aspects of the decision. Third, with respect to the operationalization of formal review of Constitutional Court decisions, standing to petition is held by the entities specified in Article 51 paragraph (1) of the MK Law, provided they can demonstrate a direct connection between themselves and the norm arising from the contested Constitutional Court decision. The touchstone (batu uji) employed comprises the provisions governing judicial procedure—covering the filing of petitions, examination in hearings, and the rendering of decisions—together with the principles of procedural law set out in the MK Law, the Law on Judicial Power, and the Constitutional Court Regulations.
