Kode etik profesi penegak hukum Indonesia :: Suatu tinjauan filosofis

Penelitian ini bertujuan untuk mengetahui nilai-nilai moral yang terkandung dalam Pancasila, dan nilai-nilai moral yang terdapat pada Kode etik Profesi Penegak Hukum Indonesia yang mencakup Kode Etik Profesi Jaksa, Kode Etik Profesi Hakim, Kode Etik Profesi Kepolisian Negara Republik Indonesia, dan Kode Etik Profesi Advokat Indonesia. Selanjutnya membuktikan hubungan kesesuaian antara nilai-nilai moral yang terdapat dalam Kode Etik Profesi Penegak Hukum Indonesia dengan nilai-nilai moral yang terkandung dalam Pancasila. Objek penelitian adalah Kode Etik Profesi Jaksa, Kode Etik Profesi Hakim, Kode Etik Profesi Kepolisian Negara Republik Indonesia, dan Kode Etik Profesi Advokat Indonesia, dengan menggunakan metode hermeneutik dan deskriptif dengan pendekatan holistik. Hasil penelitian menunjukkan adanya kesesuaian antara nilai-nilai moral yang terdapat dalam Kode Etik Profesi Penegak Hukum Indonesia (Kode Etik Profesi Jaksa, Kode Etik Profesi Hakim, Kode Etik Profesi Kepolisian Negara Republik Indonesia, dan Kode Etik Profesi Advokat Indonesia), yang meliputi taqwa terhadap Tuhan Yang Maha Esa, jujur, adil, setia, bijaksana, bertanggung jawab, dan berbudi luhur/tidak tercela dengan nilai-nilai moral yang terkandung dalam Pancasila. Hal ini berarti Kode etik Profesi penegak Hukum Indonesia tidak bertentangan dengan nilai-nilai moral Pancasila.

This research aims at identifyin g both the moral values in Pancasila, and the Profession Ethics Code of Indonesian Law Enforcer and the ones the Profession Ethics Code of Indonesian Law Enforcer Profession, including the profession ethics code of attorney, judge, police, and lawyer. Then the research showed the appropriateness between the moral values in Profession Ethics Code of Indonesian Law Enforcer and in Pancasila. Teh object of research is the Profession Ethics Code of Indonesian Law Enforcer Profession, including the profession ethics code of attorney, judge, police, and lawyer. It applied hermeneutic and descriptive method with the holistic approach. The result of the research indicated that there was relevancy between the moral values in the Ethics Code of Indonesian Law Enforcer Profession (The Ethics Code of Attorney, Judge, Police, and Lawyer), including having belief in God, honesty, justice, wisdom, responsibility, and more noble character / not being disable with the moral values of Pancasila.
