ASAS PROMULGATIE PUTUSAN PAILIT DITINJAU DARI KEPASTIAN HUKUM BAGI KREDITOR

Penelitian ini bertujuan untuk
mengetahui dan menganalisis bagaimana asas promulgatie dalam Undang-Undang
Nomor 37 Tahun 2004 tentang Kepailitan dan Penundaan Kewajiban Pembayaran Utang
(UUK-PKPU) merefleksikan prinsip kepastian hukum bagi kreditor, serta mengkaji
peran digitalisasi media publikasi kepailitan dalam meningkatkan implementasi
asas tersebut guna memberikan pelindungan hukum yang lebih efektif.
Penelitian ini merupakan penelitian
hukum normatif yang menggunakan pendekatan kasus dan pendekatan komparatif.
Data penelitian bersumber dari data sekunder yang terdiri dari bahan hukum
primer, sekunder, dan tersier, serta didukung oleh data primer berupa hasil
wawancara dengan kurator sebagai praktisi lapangan. Data yang diperoleh
dianalisis secara kualitatif dan disajikan secara deskriptif, evaluatif, dan
preskriptif untuk menarik kesimpulan secara induktif.
Hasil penelitian menunjukkan bahwa meskipun Pasal 15 ayat (4) UUK-PKPU secara tegas mewajibkan publikasi putusan pailit, dalam praktiknya asas promulgatie belum sepenuhnya merefleksikan prinsip kepastian hukum substantif bagi kreditor. Terdapat kesenjangan antara law in books dan law in action, di mana publikasi konvensional melalui surat kabar harian dan Berita Negara Replublik Indonesia mulai tidak relevan dan kurang efektif dalam menjangkau seluruh kreditor di era digital, sehingga berpotensi merugikan hak-hak kreditor yang tidak mengetahui status pailit debitornya. Oleh karena itu, digitalisasi media publikasi kepailitan menjadi urgensi sebagai bentuk pelindungan hukum preventif dan represif guna menjamin transparansi, aksesibilitas informasi, dan kepastian hukum yang berkeadilan bagi seluruh kreditor.
This research aims to examine and analyze how the promulgatie principle within Law Number 37 of 2004 concerning Bankruptcy and Suspension of Debt Payment Obligations (UUK-PKPU) reflects the principle of legal certainty for creditors, as well as to evaluate the role of digitalizing bankruptcy publication media in enhancing the implementation of this principle to provide more effective legal protection.
This study is a normative legal research employing case and comparative approaches. The data are derived from secondary sources consisting of primary, secondary, and tertiary legal materials, supplemented by primary data obtained through interviews with receivers as practitioners. The collected data were analyzed qualitatively and are presented through descriptive, evaluative, and prescriptive methods to draw inductive conclusions.
The findings indicate that although Article 15 paragraph (4) of the UUK-PKPU explicitly mandates the publication of bankruptcy verdicts, in practice, the promulgatie principle has not fully reflected substantive legal certainty for creditors. There is a discernible gap between law in books and law in action, where conventional publication via daily newspapers has become increasingly irrelevant and ineffective in reaching all creditors in the digital era, potentially jeopardizing the rights of creditors who remain unaware of the debtor's bankruptcy status. Consequently, the digitalization of bankruptcy publication media is an urgent necessity as a form of preventive and repressive legal protection to ensure transparency, information accessibility, and equitable legal certainty for all creditors.
