This research analyzes the post-revision legal political phenomenon of the Papua Special Autonomy Law (Otsus), particularly concerning the territorial split policy that resulted in the formation of new autonomous regions (DOB) through the establishment of four new provinces in 2022. The background of this research is rooted in the fundamental shift of asymmetric decentralization policy in Papua, which was initially designed to empower local communities yet curently tends to strengthen state control. The main focus of the research is to examine how the practice of autocratic legalism operates in the process of revising the Special Autonomy Law No. 21 of 2001 into Law No. 2 of 2021, as well as how legal mechanisms are used as instruments to perpetuate the power of central elites in the Papua region.

This research uses a qualitative approach with an explanatory case study method. This research data is sourced from secondary data collected using the narrative literature review method, by exploring product documents such as Laws, Government Regulations, academic manuscripts, scientific publications, and mass media. Research findings indicate that the Revision of the Papua Special Autonomy Law reflects the main characteristics of autocratic legalism as proposed by Kim Lane Scheppele, where the rulers use legal mechanisms procedurally to expand executive power and limit political participation. One crucial piece of evidence is the amendment to Article 76, which eliminates the requirement for approval from the Papua People's Council (MRP) and the Papua Regional Representative Council (DPRP) in the territorial split process, thereby transforming the expansion mechanism from originally bottom-up to fully top-down.

This study concludes that the territorial split in Papua post-revision of the Special Autonomy Law is not merely an administrative policy for improving public services, but rather a form of reordering and territorial control by the state. This practice demonstrates the decline of democracy in Indonesia, where the law no longer functions as a controller of power rule of law, more accurately becoming a tool of power itself rule by law. Theoretically, this research expands the study of autocratic legalism by demonstrating that legal manipulation can operate through the design of sub-national territorial governance to control the essence of decentralization for the benefit of state political interests.
