Pelaksanaan Keadilan Restoratif terhadap Perkara Tindak Pidana Kekerasan dalam Rumah Tangga di Wilayah Hukum Kejaksaan Tinggi Nusa Tenggara Timur

Penelitian ini bertujuan untuk menganalisis pelaksanaan keadilan restoratif oleh Kejaksaan Tinggi Nusa Tenggara Timur, mengkaji prosedur pelaksanaan yang dijalankan oleh Jaksa, dan hubungan pelaku dengan korban pascapelaksanaan, serta merumuskan rekomendasi mekanisme yang lebih berorientasi pada pemenuhan hak korban dan pencegahan kekerasan berulang.

Penelitian ini menggunakan metode normatif-empiris dengan memanfaatkan data primer, sekunder, dan tersier. Teknik pengumpulan data dilakukan melalui studi dokumen serta wawancara dengan responden yang terlibat langsung dalam pelaksanaan keadilan restoratif terhadap perkara Kekerasan dalam Rumah Tangga(KDRT) di wilayah hukum Kejaksaan Tinggi Nusa Tenggara Timur. Responden tersebut meliputi aparat penegak hukum dari Kejaksaan Tinggi dan Kejaksaan Negeri di Nusa Tenggara Timur, korban dan pelaku KDRT, serta pendamping korban dari Lembaga Bantuan Hukum(LBH) APIK. Data dianalisis secara kualitatif dan disajikan secara deskriptif.

Hasil penelitian menunjukkan dua kesimpulan: Pertama, pelaksanaan keadilan restoratif yang dijalankan oleh Kejaksaan Tinggi NTT belum berjalan secara optimal, baik dari aspek normatif maupun empiris. Secara empiris, prosedur formal yang telah dilaksanakan cenderung berorientasi pada penyelesaian administratif melalui perdamaian, tanpa memastikan tercapainya tujuan utama keadilan restoratif, yaitu pemulihan korban dan pencegahan kekerasan berulang. Secara normatif, Peraturan Kejaksaan No. 15 Tahun 2020 belum mampu berfungsi sebagai landasan normatif yang memadai dalam pelaksanaan keadilan restoratif, di mana kondisi ini terlihat pada ketiadaan legitimasi yang kuat dalam UU Kejaksaan serta pengaturan yang belum memperhatikan kekhasan perkara KDRT. Kedua, berlakunya Kitab Undang-Undang Hukum Acara Pidana Tahun 2025 membawa kemajuan signifikan dalam pengaturan keadilan restoratif, namun ketentuan tersebut belum diikuti dengan peraturan pelaksana dari Pemerintah yang mengatur penyesuaian implementasinya. Kedepannya, keadilan restoratif dalam perkara KDRT harus menjadi sarana pemulihan korban, pertanggungjawaban pelaku, dan pencegahan kekerasan berulang.

This study aims to analyze the implementation of restorative justice by the East Nusa Tenggara High Prosecutor's Office, examine the operational procedures carried out by prosecutors, assess the post-implementation relationship between offenders and victims, and formulate mechanical recommendations that are more oriented toward fulfilling victims' rights and preventing recurring violence.

This study employs a normative-empirical research method, utilizing primary, secondary, and tertiary data sources. Data were collected through document studies and interviews with respondents directly involved in the implementation of restorative justice for domestic violence cases within the jurisdiction of the East Nusa Tenggara High Prosecutor's Office. Respondents include law enforcement officers from the High and District Prosecutor's Offices in East Nusa Tenggara, victims and perpetrators of domestic violence, and victim advocates from the APIK Legal Aid Institute (LBH APIK). The data were analyzed qualitatively and presented descriptively.

The results of the study demonstrate two primary findings: First, the implementation of restorative justice by the East Nusa Tenggara High Prosecutor's Office has not operated optimally from either normative or empirical perspectives. Empirically, the formal procedures carried out tend to be oriented toward administrative settlement through peace agreements, without ensuring the achievement of the ultimate goals of restorative justice, namely victim recovery and the prevention of recurring violence. Normatively, Prosecutor's Regulation (Perja) No. 15 of 2020 has been inadequate as a normative framework for implementing restorative justice, a condition reflected in the lack of strong statutory legitimacy within the Prosecution Service Law, as well as regulations that fail to accommodate the specific characteristics of domestic violence cases. Second, the enactment of the 2025 Criminal Procedure Code (KUHAP) marks significant progress in the regulation of restorative justice; however, these provisions have not been followed by implementing regulations from the Government to govern its operational adjustments. Moving forward, restorative justice in domestic violence cases must serve as a mechanism for victim recovery, offender accountability, and the prevention of recurring violence.
