Penyelesaian konflik penguasaan hak atas tanah antara masyarakat dengan PT. Poleko Jaya Agung di Dusun Kassa Kecamatan Patampanua Kabupaten Pinrang

Penelitian ini bertujuan untuk mengetahui mengetahui terjadinya terjadinya konflik penguasaan tanah antara masyarakat dengan PT. Poleko Jaya Agung, cara yang digunakan dalam penyelesaian konflik serta Kendala-kendala apa yang hadapi dalam penyelesaian konflik penguasaan tanah di Desa Kassa Kecamatan Patampanua Kabupaten Pinrang. Penelitian mengenai Penyelesaian Konflik Penguasaan Hak Atas Tanah antara Masyarakat dengan PT. Poleko Jaya Agung di Desa Kassa Kecamatan Patampanua Kabupaten Pinrrang merupakan penelitian yang bersifat empiris walaupun tetap dilakukan penelitian yuridis normatif. Penelitian ini dilakukan di Desa Kassa Kecamatan Patampanua KabupatenPinrang. Berdasarkan hasil penelitian dapat dikemukakan bahwa terjadinya konflik penguasaan tanah ditimbulkan karena terbitnya risalah pemeriksaan tanah atas permohonan dan perpanjangannya Hak Guna Usaha tidak sesuai dengan kondisi dilapangan. Hal ini dijadikan dasar dikeluarkannya pemberikan Hak Guna Usaha. Permohonan perpanjangan Hak Guna Usaha dilakukan 8 (delapan) bulan sebelum berakhirnya jangka waktu, Hal tersebut tidak sesuai ketentuan Pasal 10 PP. Nomor 40 Tahun 1996 yang mengatur bahwa permohonan jangka waktu Hak Guna Usaha diajukan selambat-lambatnya 2 (dua) tahun sebelum berakhirnya jangka waktu Hak Guna Usaha. Penyelesaian konflik penguasaan tanah dilakukan dengan upaya mempertemukan masyarakat penuntut dan pihak PT. Poleko Jaya Agung melalui LBH Makassar, penyelesaian melalui Tim Penyelesaian Konflik di Kabupaten serta Penyelesaian melalui DPRD Propinsi Sulawesi Selatan. Penyelesaian yang dilakukan belum menghasilkan kesepakatan dan mendapat kendala dalam penyelesaian yaitu: dikarenakan pihak PT. Poleko Jaya Agung menghindari adanya pertemuan, upaya para pihak untuk menguasai lahan, serta DPRD Sulawesi Selatan berjanji kepada masyarakat penuntut untuk melakukan beberapa tindakan untuk mendesak BPN Sulawesi Selatan membentuk Tim verifikasi Hak Guna Usaha PT. Poleko Jaya Agung. Upaya yang dijanjikan oleh pihak DPRD Sulawesi Selatan tersebut tidak dilakukan.

The research aims to investigate the causes for the conflict over land ownership between the society and PT. Poleko Jaya Agung, the way to solve the dispute, and obstacles to be encountered in the settlement of the conflict over land ownership in Kassa village, Patampanua Sub-district, Pinrang Regency. The research belongs to an empirical research and also a juridical normative research. It is done in Kassa village, Patampanua Sub-district, Pinrang Regency. The research results reveal that the conflict over land ownership happens because of the issuance of the summary of land examination based on a request, while the renewal for the Rights of Commercial Use is not true as in the real condition in the field. This is then used as the base for the issuance of the granting of the rights of Commercial Use. The application for the Right of Commercial Use renewal is done in 8 months before the expiry, which is not in accordance with Article 10 of the Government Regulation No. 40/1996. This article regulates that the application for the Right of Commercial Use renewal must be made 2 years for the latest before the expiry. The settlement of conflict over land ownership is achieved by arranging a meeting between the litigant and PT Poleko Jaya Agung through the Advocate Office of Makassar, settlement through the Conflict Resolution Team of Pinrang Regency, and settlement through the House of Representative of South Sulawesi Province. These settlements have not brought an agreement between the parties, and encountered many problems. The problems include the fact that PT Poleko Jaya Agung avoid the meeting; the attempt of the parties to occupy the land; and the promise of the House of Representative of South Sulawesi Province to assist the society as litigant to carry out several efforts to push the Office of Land Affairs of South Sulawesi to form a verification team to examine the Rights of Commercial Use of PT Poleko Jaya Agung. However, the promise of the House of Representative has not been carried out.
