Penulisan tesis ini dilatarbelakangi oleh masih ditemukannya berbagai permasalahan dalam pelaksanaan koordinasi dan pengawasan antara Penyidik Pegawai Negeri Sipil (PPNS) Kehutanan dengan Penyidik Polri dalam penanganan tindak pidana perusakan hutan di Sulawesi Tenggara. Tesis ini bertujuan untuk: pertama, mengetahui dan menganalisis problematika implementasi koordinasi dan pengawasan antara PPNS dan Penyidik Polri dalam penyidikan tindak pidana perusakan hutan di Sulawesi Tenggara; kedua, memformulasikan model koordinasi dan pengawasan yang ideal guna meningkatkan efektivitas penegakan hukum kehutanan di masa yang akan datang.
Metode penelitian yang digunakan adalah penelitian hukum normatif-empiris dengan pendekatan peraturan perundang-undangan dan pendekatan kasus. Penelitian ini mengkaji ketentuan hukum positif yang mengatur kewenangan PPNS dan Polri, antara lain Kitab Undang-Undang Hukum Acara Pidana (KUHAP), Undang-Undang Nomor 41 Tahun 1999 tentang Kehutanan, serta Undang-Undang Nomor 18 Tahun 2013 tentang Pencegahan dan Pemberantasan Perusakan Hutan, serta menganalisis implementasinya melalui studi lapangan di Sulawesi Tenggara. Teknik analisis data dilakukan secara kualitatif dengan pendekatan deskriptif-analitis dan penarikan kesimpulan secara deduktif.
Hasil penelitian menunjukkan dua kesimpulan. Pertama, Implementasi koordinasi dan pengawasan antara PPNS Kehutanan dan Penyidik Polri dalam penyidikan tindak pidana perusakan hutan belum optimal. Berdasarkan teori sistem hukum Lawrence M. Friedman, pada aspek struktur hukum koordinasi telah berjalan secara formal namun belum terintegrasi, pada aspek substansi hukum pengaturannya belum operasional sehingga menimbulkan perbedaan pelaksana koordinasi, dan pada aspek budaya hukum masih dipengaruhi ego sektoral, persepsi masyarakat bahwa hanya Polri sebagai penyidik utama serta belum terbentuk budaya kerja kolaboratif; kedua, optimalisasi koordinasi ke depan memerlukan rekonstruksi mekanisme yang terintegrasi melalui pembentukan forum koordinasi permanen, penyusunan pedoman teknis bersama, serta harmonisasi implementatif antara KUHAP, Undang-Undang Kehutanan, dan Undang-Undang P3H guna mewujudkan penegakan hukum kehutanan yang efektif, transparan, dan akuntabel.
This thesis was written in response to the ongoing challenges in coordinating and supervising the work of Civil Servant Forestry Investigators (PPNS) and National Police Investigators in handling criminal cases of forest destruction in Southeast Sulawesi. This thesis aims, first, to examine and analyze the problems in the implementation of coordination and supervision between PPNS and National Police investigators in the investigation of criminal acts of forest destruction in Southeast Sulawesi; and second, to formulate an ideal model of coordination and supervision to improve the effectiveness of forestry law enforcement in the future.
The research method used was normative-empirical legal research with a regulatory and case approach. This study examined the positive legal provisions governing the authority of PPNS and Polri, including the Criminal Procedure Code (KUHAP), Law No. 41 of 1999 on Forestry, and Law No. 18 of 2013 on the Prevention and Eradication of Forest Destruction, and analyzes their implementation through field studies in Southeast Sulawesi. Data analysis techniques were carried out qualitatively using a descriptive-analytical approach and deductive conclusions.
The research findings point to two conclusions. First, the coordination and oversight between Forestry PPNS and National Police investigators in the investigation of criminal acts of forest destruction have not been optimal. Based on Lawrence M. Friedman’s legal system theory, in terms of legal structure, coordination has been carried out formally but remains unintegrated; in terms of legal substance, the regulations are not yet operational, leading to discrepancies among those implementing coordination; and in terms of legal culture, it is still influenced by sectoral egos, the public perception that only the National Police serve as the primary investigators, and the absence of a collaborative work culture; second, Optimizing future coordination requires the reconstruction of integrated mechanisms through the establishment of a permanent coordination forum, the development of joint technical guidelines, and the harmonization of implementation between the Criminal Procedure Code (KUHAP), the Forestry Law, and the P3H Law to achieve effective, transparent, and accountable forestry law enforcement.
