DINAMIKA PERGESERAN TAFSIR MAHKAMAH KONSTITUSI ATAS MODEL KESERENTAKAN PEMILU

Penelitian ini bertujuan untuk memahami dinamika pergeseran tafsir Mahkamah Konstitusi (MK) atas model keserentakan Pemilu dalam pengujian undang-undang. Putusan MK yang dikaji dalam memahami pergeseran tersebut adalah Putusan MK 14/2013, Putusan MK 55/2019 dan Putusan MK 135/2024. Penelitian ini juga bertujuan untuk memahami aspek konstitusional yang harus diperhatikan oleh pembentuk undang-undang dalam menindaklanjuti Putusan MK 135/2024. Jenis penelitian yang digunakan adalah penelitian hukum normatif melalui studi kepustakaan dengan data primer, sekunder dan tersier. Dalam menganalisis data digunakan pendekatan perundang-undangan, pendekatan kasus dan pendekatan konseptual. 

Hasil penelitian menunjukkan dua hal utama. Pertama, terhadap dinamika model keserentakan Pemilu dalam putusan yang penulis kaji dapat terlihat dari tiga aspek, yaitu: 1) mengenai model keserentakan Pemilu; 2) mengenai argumen MK; dan 3) mengenai sikap MK. Atas pergeseran yang terjadi, penulis menilai bahwa pergeseran tersebut telah sesuai dengan legitimasi tafsir konstitusi dan dapat dibenarkan serta pergeseran yang terjadi diakibatkan baik oleh faktor internal dan faktor eksternal. Kedua, terdapat tiga aspek konstitusional yang harus diperhatikan oleh pembentuk undang-undang dalam menindaklanjuti Putusan MK 135/2024, yaitu: 1) konstitusionalitas model keserentakan Pemilu dan kaitannya dengan Pilkada secara langsung; 2) aspek penjadwalan Pemilu Nasional dan Pemilu Daerah; dan 3) aspek peralihan masa jabatan.

This study aims to understand the dynamics of the Constitutional Court's (MK) shift in interpretation of the simultaneous election model in judicial review. The Constitutional Court decisions examined to understand this shift are MK Decision 14/2013, MK Decision 55/2019, and MK Decision 135/2024. This study also aims to understand the constitutional aspects that lawmakers must consider in following up on MK Decision 135/2024. The research used is normative legal research through literature review using primary, secondary, and tertiary data. The data analysis employed a statute approach, a case study approach, and a conceptual approach.

The results of the study reveal two main points. First, the dynamics of the simultaneous election model in the decisions reviewed can be seen from three aspects: 1) the simultaneous election model; 2) the Constitutional Court's arguments; and 3) the Constitutional Court's stance. Regarding the shift that occurred, the author assesses that the shift is in accordance with the legitimacy of constitutional interpretation and is justifiable, and that the shift was caused by both internal and external factors. Second, there are three constitutional aspects that lawmakers must consider in following up on Constitutional Court Decision 135/2024, namely: 1) the constitutionality of the simultaneous election model and its relationship to direct regional elections; 2) the scheduling aspect of the National and Regional Elections; and 3) the transition aspect of the term of office.
