Tesis ini menganalisis fenomena difusi norma hak asasi manusia, khususnya terkait
paradigma keadilan restoratif, melalui kerja sama bilateral strategis antara Direktorat Jenderal
Pemasyarakatan Indonesia dan lembaga Reclassering Nederland. Latar belakang utama penelitian
ini berakar pada krisis sistemik pemasyarakatan di Indonesia yang ditandai oleh kelebihan
kapasitas penjara (overcrowding) ekstrem, yang kemudian memicu pelanggaran hak asasi manusia
secara masif. Di samping itu, terdapat keterbatasan implementasi pada undang-undang
pemasyarakatan yang baru akibat adanya kesenjangan kapasitas institusional. Dengan
menggunakan lensa teori konstruktivisme dalam hubungan internasional, siklus hidup norma, dan
konsep lokalisasi norma, penelitian ini mengeksplorasi secara mendalam bagaimana ide dan
kebijakan pidana alternatif ditransfer, direnegosiasikan, dan diadaptasi ke dalam sistem peradilan
pidana Indonesia yang secara historis memiliki akar budaya punitif yang kental. Hasil analisis
mengonfirmasi bahwa proses difusi ini tidak terjadi sebagai sebuah transplantasi hukum yang
mekanistik dan pasif. Sebaliknya, proses ini berjalan melalui mekanisme lokalisasi yang aktif, di
mana aktor-aktor domestik secara cermat memadukan standar praktik terbaik dari Belanda dengan
kearifan lokal seperti nilai musyawarah. Keberhasilan transfer ini melahirkan model
pemasyarakatan hibrida yang relevan dan lebih beradab.
This thesis analyzes the phenomenon of human rights norm diffusion, particularly
regarding the paradigm of restorative justice, through strategic bilateral cooperation between
Indonesia’s Directorate General of Corrections and the Dutch institution Reclassering Nederland.
The main background of this study lies in the systemic crisis of Indonesia’s correctional system,
which is marked by extreme prison overcrowding that has triggered widespread human rights
violations. In addition, the implementation of the new correctional law remains limited due to
significant institutional capacity gaps.
Employing the theoretical lenses of constructivism in International Relations, the norm life
cycle, and norm localization, this research explores in depth how ideas and policies on alternative
sentencing are transferred, renegotiated, and adapted into Indonesia’s criminal justice system,
which historically has deep-rooted punitive cultural legacies. The findings confirm that this
diffusion process has not occurred as a mechanistic and passive legal transplant. Rather, it proceeds
through an active localization mechanism in which domestic actors carefully combine Dutch best
practices with local wisdom, such as the value of deliberation (musyawarah). The success of this
policy transfer has given rise to a hybrid correctional model that is both contextually relevant and
more humane.
