Fairness in YouTube Music Copyright Enforcement under the US Copyright Framework: A Systematic and Legal Analysis of YouTube’s Content ID, its Approaches to Alterations of Work in Music, and A Lesson for Indonesia

Tesis ini mengkaji keadilan dalam penegakan hak cipta musik di YouTube, dengan
berfokus pada sistem Content ID serta perlakuannya terhadap karya musik yang telah
mengalami perubahan, dengan implikasi khusus bagi Indonesia. Tesis ini mengajukan tiga
pertanyaan utama: apakah sistem YouTube beroperasi selaras dengan kerangka hukum hak
cipta Amerika Serikat; merumuskan kemungkinan reformasi terhadap sistem YouTube demi
mencapai keadilan; serta bagaimana penyedia layanan digital yang sebagian besar bersifat
swakelola dapat diposisikan dalam konteks hukum Indonesia.
Tesis ini berpendapat bahwa karya yang telah mengalami perubahan seperti remix,
cover, dan bentuk adaptasi lainnya secara sistematis dirugikan dalam hal remunerasi ekonomi
akibat mekanisme deteksi otomatis yang memprioritaskan rekaman asli dan klaim distributor.
Lebih lanjut, ditemukan bahwa Content ID cenderung mendeteksi kesamaan secara berlebihan
dalam karya audio, sementara perbedaan yang bersifat subjektif antara karya transformatif dan
karya turunan menyebabkan konsep “fair use” sulit untuk dioperasionalkan dalam sistem
otomatis. Meskipun Content ID itu sendiri bukan merupakan sumber permasalahan utama,
ekosistem distributor yang menciptakan mekanisme “kesamaan terdeteksi sama dengan
pengalihan keuntungan” justru menimbulkan dampak ekonomi yang merugikan bagi para
kreator.
Untuk mengatasi permasalahan tersebut, tesis ini mengusulkan penggunaan teori musik
sebagai kerangka yang lebih objektif dalam menilai orisinalitas, serta mendorong penerapan
standar berbasis keahlian pada bidang kreatif lainnya. Dengan menggunakan prinsip
proporsionalitas, keseimbangan kepentingan, dan due process sebagai tolok ukur analitis, tesis
ini menyimpulkan bahwa sistem YouTube, meskipun secara umum selaras dengan hukum hak
cipta Amerika Serikat, masih mengandung inkonsistensi teknis yang mengurangi tingkat
keadilannya.
This thesis examines the fairness of music copyright enforcement on YouTube, focusing on
the Content ID system and its treatment of altered musical works, with particular implications for
Indonesia. It addresses three key questions: whether YouTube’s system operates in line with the
United States copyright framework; concepts possible reforms of YouTube’s system in pursuit of
fairness; and how a largely self-regulating digital service provider could be positioned in the
Indonesian legal context.
The thesis argues that altered works such as remixes, covers, and other forms of
adaptations are systematically disadvantaged in economic remuneration due to automated
detection mechanisms that prioritize original recordings and distributor claims. It further finds
that Content ID over-detects similarities in audio works, while the subjective distinction between
transformative and derivative works renders fair use difficult to operationalize in an automated
system. While Content ID in itself is not at fault, the Distributor ecosystem which creates a
“detected similarity equals profit redirection” system is economically harmful for content creators.
To address these issues, the thesis proposes incorporating music theory as a more objective
framework for assessing originality, and urges other expert-based standards for other creative
fields. Applying proportionality, balancing of interests, and due process as analytical benchmarks,
it concludes that YouTube’s system, while broadly aligned with U.S. copyright law, contains
technical inconsistencies that undermine fairness.
