ANALISIS YURIDIS TERHADAP PRAKTIK PERIKANAN DESTRUKTIF DAN PENEGAKAN HUKUMNYA DIWILAYAH PESISIR KABUPATEN MANOKWARI

2026 | Skripsi | ILMU HUKUMPenelitian ini menggunakan metode yuridis normatif yang didukung pendekatan empiris untuk menganalisis penerapan dan penegakan hukum terhadap praktik perikanan destruktif di Kelurahan Padarni Borarsi, Kabupaten Manokwari. Hasil penelitian menunjukkan bahwa praktik perikanan destruktif masih terjadi, meliputi penggunaan bom ikan, bahan kimia berbahaya, alat tangkap tidak ramah lingkungan, serta penangkapan ikan berlebihan (overfishing). Praktik tersebut berdampak pada kerusakan ekosistem laut, penurunan populasi ikan, rusaknya terumbu karang, serta kerugian sosial ekonomi masyarakat pesisir.
This study uses a normative juridical method supported by an empirical approach to analyze the implementation and enforcement of law against destructive fishing practices in Padarni Borarsi Village, Manokwari Regency. The results show that destructive fishing practices still occur, including the use of fish bombs, hazardous chemicals, non-environmentally friendly fishing gear, and overfishing. These practices have significant impacts on marine ecosystem damage, declining fish populations, destruction of coral reefs, and socio-economic losses for coastal communities.
Normatively, these actions are contrary to the provisions of fisheries and environmental legislation. However, empirically, law enforcement has not been effective due to limited monitoring facilities, the vastness of marine areas, weak inter-agency coordination, and low legal awareness among the community. Economic factors also serve as the main driver of these practices. Therefore, strengthening law enforcement, improving supervision, and empowering coastal communities are necessary to achieve sustainable fisheries resource management.
