Tindak pidana korupsi yang dilakukan oleh korporasi menimbulkan tantangan tersendiri dalam penegakan hukum, terutama ketika berkaitan dengan upaya pemulihan kerugian keuangan negara. Penelitian ini bertujuan untuk membahas kebijakan pengembalian kerugian keuangan negara melalui pidana uang pengganti terhadap tindak pidana korupsi yang dilakukan oleh korporasi dalam sistem hukum Indonesia. Metode yang digunakan adalah penelitian yuridis normatif dengan pendekatan perundang-undangan, kasus, dan konseptual. Hasil penelitian menunjukkan bahwa permasalahan utama terletak pada belum optimalnya pengaturan pidana uang pengganti, baik dari aspek substansi hukum, struktur hukum, maupun budaya hukum. Ketidakjelasan pengaturan mengenai orientasi pidana uang pengganti, antara sebagai sarana pengembalian kerugian negara atau instrumen perampasan hasil tindak pidana, menimbulkan disparitas putusan pengadilan dalam menentukan besaran uang pengganti, pidana penjara pengganti, serta pelaksanaan eksekusi aset terpidana. Selain itu, mekanisme asset recovery juga belum berjalan efektif akibat terbatasnya pengaturan mengenai penyitaan aset sejak tahap penyidikan, lemahnya pelacakan aset hasil tindak pidana, serta belum konsistennya penerapan pertanggungjawaban pidana korporasi dalam perkara korupsi. Penelitian ini menunjukkan bahwa pembaruan hukum pidana di masa yang akan datang perlu diarahkan pada penguatan pendekatan asset recovery melalui harmonisasi regulasi, reformulasi pidana uang pengganti, penguatan sita jaminan, serta penerapan mekanisme prinsip keadilan restoratif guna mendukung pemulihan kerugian keuangan negara secara lebih efektif, terukur, dan berorientasi pada perbaikan tata kelola korporasi
Corruption crimes committed by corporations create particular challenges in law enforcement, especially in relation to efforts to recover state financial losses. This research aims to examine the policy of recovering state financial losses through replacement money penalties for corruption crimes committed by corporations within the Indonesian legal system. The method used is normative juridical research with statutory, case, and conceptual approaches. The results of the research indicate that the main problem lies in the fact that the regulation of replacement money penalties has not been optimal, both in terms of legal substance, legal structure, and legal culture. The lack of clarity regarding the orientation of replacement money penalties, whether as a means of recovering state financial losses or as an instrument for confiscating proceeds of crime, has resulted in disparities in court decisions in determining the amount of replacement money, substitute imprisonment, and the execution of the convict’s assets. In addition, the asset recovery mechanism has also not operated effectively due to the limited regulation regarding asset seizure since the investigation stage, weak tracing of assets resulting from criminal acts, and the inconsistent application of corporate criminal liability in corruption cases. This research shows that future criminal law reform needs to be directed toward strengthening the asset recovery approach through regulatory harmonization, reformulation of replacement money penalties, strengthening conservatory seizure, and the implementation of restorative justice mechanisms in order to support the recovery of state financial losses in a more effective, measurable, and corporate governance-oriented manner
