Kepailitan Terhadap Kepemilikan Aset Virtual Dalam Perspektif Hukum Kebendaan dan Tanggung Jawab Kurator

Perkembangan teknologi blockchain memunculkan aset virtual seperti Cryptocurrency dan NFT sebagai harta pailit. Di Indonesia, crypto diatur sebagai komoditas Permendag 99/2018 tentang Kebijakan Umum Penyelenggaraan Perdagangan Berjangka Aset Kripto , sementara NFT tunduk pada UU Hak Cipta 28/2014, namun Undang-Undang Kepailitan belum mengakomodasi secara eksplisit. Tantangan eksekusi meliputi penyitaan dan penjualan aset digital yang anonim, dengan risiko kerugian bagi kurator berdasarkan Pasal 72 Undang-Undang Nomor 37 Tahun 2004 tentang Kepailitan dan Penundaan Kewajiban Pembayaran Utang.

Penelitian ini bertujuan untuk menganalisis status dan kedudukan hukum aset virtual dalam perspektif hukum kebendaan dan kepailitan, kedudukan hukum pelanggan aset virtual dalam kepailitan bursa aset keuangan digital, serta bentuk perlindungan hukum bagi kurator dalam pemberesan aset virtual, termasuk perumusan model inventarisasi aset virtual berbasis sistem yang adaptif di masa mendatang. Penelitian ini menggunakan metode hukum normatif dengan pendekatan peraturan perundang-undangan dan teori-teori hukum terkait yang didukung dengan wawancara.

Hasil penelitian, menyimpulkan bahwa Cryptocurrency dan NFT secara normatif diakui sebagai aset tidak berwujud yang dapat menjadi harta pailit, namun belum diikuti pengaturan teknis kepailitan yang memadai. Perlindungan pelanggan bergantung pada segregasi aset sebagaimana POJK 27/2024. Kurator berwenang mengelola aset virtual dengan tanggung jawab hukum terbatas sepanjang bertindak hati-hati. Penelitian ini mengusulkan inventarisasi berbasis blockchain sebagai pembaruan hukum kepailitan.

The rapid development of blockchain technology has given rise to virtual assets such as cryptocurrencies and non-fungible tokens (NFTs) as objects of bankruptcy estates. In Indonesia, cryptocurrencies are regulated as commodities under Ministry of Trade Regulation No. 99 of 2018 on the General Policy for the Implementation of Crypto Asset Futures Trading, while NFTs are subject to Law No. 28 of 2014 on Copyright. However, the Bankruptcy Law has not explicitly accommodated virtual assets. Challenges in execution include the seizure and sale of anonymous digital assets, which may expose curators to potential liability under Article 72 of Law No. 37 of 2004 on Bankruptcy and Suspension of Debt Payment Obligations.

This research aims to analyze the legal status and position of virtual assets from the perspective of property law and bankruptcy law, the legal standing of virtual asset customers in the bankruptcy of digital financial asset exchanges, as well as legal protection for curators in the administration and liquidation of virtual assets, including the formulation of an adaptive virtual asset inventory system for the future.This study employs a normative legal research method using statutory and theoretical approaches, supported by interviews.

The findings conclude that cryptocurrencies and NFTs are normatively recognized as intangible assets that may constitute bankruptcy estates, yet are not accompanied by adequate technical bankruptcy regulations. Customer protection depends on asset segregation as stipulated in POJK No. 27 of 2024. Curators are authorized to manage virtual assets with limited legal liability provided they act prudently. This research proposes a blockchain-based inventory system as a prospective reform of bankruptcy law.
