Peran Dinas Lingkungan Hidup Kabupaten Magetan Dalam Implementasi Perizinan Berusaha Berbasis Risiko

PP 28/2025 menyederhanakan alur birokrasi perizinan demi meningkatkan investasi. Namun, hal ini memunculkan kekhawatiran akan terabaikannya aspek pengawasan lingkungan yang berdampak pada peran DLH Kabupaten Magetan dalam memberikan pelayanan dan pengawasan demi menjamin perlindungan masyarakat sekitar LIK Magetan. Penelitian ini bertujuan untuk mengidentifikasi perubahan peran pelayanan DLH Kabupaten Magetan dalam perizinan berusaha berbasis risiko sekaligus mengetahui pelaksanaan pengawasan DLH di LIK Magetan guna menjamin perlindungan masyarakat, baik sebelum maupun sesudah berlakunya PP 28/2025. Penelitian ini merupakan jenis penelitian normatif-empiris yang bersifat deskriptif. Data primer diperoleh melalui studi lapangan dengan teknik wawancara dengan responden yang ditentukan secara purposive sampling. Data sekunder dikumpulkan melalui studi kepustakaan terhadap bahan hukum primer, sekunder, dan tersier. Seluruh data dianalisis secara kualitatif untuk kemudian disajikan dalam bentuk narasi deskriptif yang komprehensif.  Hasil penelitian menunjukkan bahwa sebelum PP 28/2025, DLH berperan dalam pelayanan langsung izin lingkungan. Pasca PP 28/2025 bertransformasi melalui pemenuhan standar SLA dan penguatan posisi dalam TUK. Namun, SLA berisiko menurunkan kualitas penilaian substansi karena verifikasi lapangan mendalam sulit dilakukan sekaligus berisiko kehilangan hak, sehingga lebih menitikberatkan pada aspek pengawasan pasca-izin dan pemberian sanksi. Efektivitas pengawasan masih terhambat oleh ketidakpatuhan hukum terkait kepemilikan NIB dan Pertek serta manipulasi data risiko oleh pelaku usaha yang menciptakan celah pemantauan. Upaya perlindungan masyarakat di LIK Magetan diwujudkan melalui mekanisme pengaduan manual maupun digital serta pemantauan baku mutu limbah secara rutin oleh DLH.  Oleh karena itu, diperlukan penguatan koordinasi antara fungsi teknis DLH dengan fungsi administratif DPMPTSP untuk memastikan bahwa penyederhanaan birokrasi melalui OSS-RBA tidak mengabaikan hak masyarakat atas lingkungan hidup yang sehat.  

Government Regulation No. 28 of 2025 simplifies the bureaucratic process of licensing to boost investment. However, this raises concerns about the neglect of environmental oversight, which impacts the role of the Magetan Regency Environmental Agency in providing services and supervision to ensure the protection of the surrounding community near the Magetan Small Industrial Zone. This research aims to identify changes in the role of the Magetan Regency Environmental Agency in risk-based business licensing and to understand the implementation of supervision by the Environmental Agency in the Magetan Small Industrial Zone to ensure community protection, both before and after the enactment of Government Regulation No. 28 of 2025.

This research is a type of normative-empirical study that is descriptive in nature. Primary data were obtained thru field studies using interview techniques with respondents determined by purposive sampling. Secondary data were collected thru literature studies on primary, secondary, and tertiary legal materials. All data were analyzed qualitatively and then presented in the form of a comprehensive descriptive narrative.

The result of the study show that post GR 28/2025, Magetan Environmental Agency's role shifted from direct licensing to becoming a technical authority within the Feasibility Test Team (TUK) to meet faster service standards (SLA). SLA risks lowering the quality of substantive assessments because in-depth field verification is difficult to carry out and risks losing rights, thus placing more emphasis on post-permit supervision and sanctions. However, this supervision is still hindered by business operators who manipulate risk data or fail to comply with legal permits (NIB and Pertek). In Magetan's industrial area (LIK), community protection is carried out through digital and manual complaint channels and routine waste monitoring. Therefore, stronger coordination between the technical functions (Environmental Agency) and the administrative functions (DPMPTSP) is vital to ensure that simplified bureaucracy through OSS-RBA does not ignore the community's right to a healthy environment.
