PENGATURAN PERLINDUNGAN HUKUM KETENAGAKERJAAN BAGI KORBAN PERUNDUNGAN DALAM PROGRAM PENDIDIKAN DOKTER SPESIALIS

INTISARI

Penelitian ini bertujuan untuk mengetahui dan menganalisis urgensi pengaturan perlindungan  ketenagakerjaan bagi korban perundungan dalam Program Pendidikan Dokter Spesialis. Selain itu, penelitian ini juga bertujuan untuk mengetahui dan menganalisis prospek dari pengaturan perlindungan hukum ketenagakerjaan bagi korban perundungan dalam Program Pendidikan Dokter Spesialis.

Penelitian dalam tesis ini merupakan penelitian hukum normatif yang sumber datanya adalah data sekunder dengan pendekatan peraturan perundang-undangan, pendekatan kasus, pendekatan komparatif, dan juga pendekatan konseptual. Jenis data yang digunakan adalah data sekunder,  dengan bahan hukumnya yakni bahan hukum primer, sekunder dan tersier. Kemudian, data yang diperoleh di analisis dengan deskriptif-analisis, dengan teknik evaluative-argumentative.

Penelitian ini menunjukkan dua kesimpulan; Pertama, terdapat urgensi dalam pengaturan dokter PPDS sebagai pekerja, karena terdapat kekaburan hukum, kasus perundungan dokter PPDS yang masih terjadi dengan akibat yang bisa menyebabkan kerugian baik pihak dokter PPDS itu sendiri maupun masyarakat yakni pasien. Sudah menjadi kewajiban negara untuk memperjelas kedudukan dokter PPDS sebagai pekerja hal tersebut demi kepastian hukum dokter PPDS dan sebagai Upaya preventif dalam melindungi dokter PPDS dari perundungan, kejelasan tersebut dapat dilihat juga sebagaimana tren Internasional yang melaksanakan kejelasan dokter PPDS sebagai pekerja. Kedua, Terdapat prospek dalam pengaturan dokter PPDS sebagai pekerja, diantaranya adalah pencegahan perundungan dengan dalih pemerasan dan pemberian jam Kerja berlebihan. Selain itu terdapat juga peluang rekontruksi pengaturan perlindungan perundungan pada dokter yang sedang melaksanakan Pendidikan Dokter Spesialis dari sisi ketenagakerjaan yang akan mempermudah pencegahan, pengawasan dan penegakan hukumnya jika terjadi perundungan.

REGULATION OF EMPLOYMENT LAW PROTECTION FOR VICTIMS OF BULLYING IN SPECIALIST DOCTOR EDUCATION PROGRAMS

ABSTRACT

This study aims to find out and analyze the urgency of regulating employment protection for victims of bullying in the Specialist Doctor Education Program. In addition, this study also aims to find out and analyze the prospects of the regulation of labor law protection for victims of bullying in the Specialist Doctor Education Program. 

The research in this thesis is a normative legal research whose data source is secondary data with a regulatory approach, a case approach, a comparative approach, and also a conceptual approach. The type of data used is secondary data, with legal materials namely primary, secondary and tertiary legal materials. The, the data obtained in analyzed with descriptive-analysis, with evaluative-argumentative techniques. 

The study results shows two conclusion; First, there are urgency in regulating PPDS doctors as workers, because there is legal ambiguity, cases of bullying of PPDS doctors that are still occurring with consequences that can cause losses both the PPDS doctor himself and the community, namely the patient. It is the obligation of the state to clarify the position of PPDS doctors as workers, this is for the sake of legal certainty for PPDS doctors and as a preventive effort in protecting PPDS doctors from bullying, this clarity can also be seen as an international trend that implements the clarity of PPDS doctors as workers. Second, There are prospects in the arrangement of PPDS doctors as workers, including the prevention of bullying under the pretext of extortion and the provision of excessive working hours. In addition, there is also an opportunity to reconstruct the regulation of bullying protection for doctors who are carrying out Specialist Doctor Education from the employment side which will facilitate the prevention, supervision and enforcement of the law in the event of bullying.
