Pemilihan Presiden langsung berdasarkan UUD 1945

Penelitian ini mempunyai tujuan yang bersifat deskriptif yaitu mengkaji kesesuaian pemilihan presiden langsung tahun 2004 dengan prinsip-prinsip demokrasi menurut UUD 1945; tujuan yang bersifat kreatif untuk mengidentifikasi Hal-hal apakah di dalam pemilihan presiden langsung yang belum mencerminkan prinsip demokrasi; dan tujuan inovatif untuk mengidentifikasi upaya-upaya dalam mengatasi hal-hal yang belum demokratis di dalam pemilihan presiden. Hasil penelitian menunjukkan bahwa pemilihan presiden langsung tahun 2004 telah sesuai dengan prinsip demokrasi menurut UUD 1945, sepanjang mengenai hal-hal: rakyat menentukan pilihan tanpa perantaraan wakilnya, penyelenggara pemilu yang netral, hak yang sama untuk memilih. Penelitian ini juga berhasil mengidentifikasi Hal-hal di dalam pemilihan presiden yang belum sesuai dengan prinsip demokrasi menurut UUD 1945, baik yang berkait dengan aturan hukumnya maupun pelaksanaannya. Upaya-upaya yang dapat dilakukan untuk mengatasi hal-hal yang tidak demokratis dalam pemilihan presiden dengan menyempurnakan aturan hukumnya sehingga dapat lebih mengakomodasi aspirasi rakyat, sedangkan pada pelaksanaannya dapat diatasi dengan meningkatkan kinerja penyelenggara dan pengawas pemilu serta meningkatkan kesadaran hukum kontestan dan pemilih.

The research has descriptive aim that is to analyze the relation between the 2004 presidential election and the democratic principal based on UUD 1945; the creative goal is to identify all matter that does not perform the principal of democracy; and the innovative goal is to identify the effort to overcome the undemocratic matters in the presidential election. The result of the research shows that the 2004 presidential election is fit to principal of democracy according to the UUD 1945, as the relation with: the people have their own choice without delegations, neutral electoral committee, people has the same right to choose. This research is able to identify matters in presidential election that do not perform democracy as in the UUD 1945, whether it is related to the system or the implementation. The efforts that can be done to overcome the undemocratic matters during the presidential election is by improving the system so that it can accommodate people’s needs, while in the implementation can be overcame by improving the committee’s work and the electoral supervisor and improving the law awareness of the electoral contestants
