The Daya Anagata Nusantara Investment Management Agency (BPI Danantara) is a strategic investment management institution that consolidates and optimizes government investments to support national economic growth. However, its formation has sparked conceptual and normative discourse regarding its position in Indonesia's constitutional structure. Thus, this study aims to answer two questions: i) what is the position of BPI Danantara in Indonesia's constitutional structure? and ii) how can BPI Danantara's position in Indonesia's constitutional structure be strengthened? This study is a normative study that explores secondary data in the form of primary and secondary legal materials relevant to the research topic obtained through literature studies and interviews. The data is analyzed qualitatively using a statute, conceptual, and comparative approach.
The results of this study show two conclusions. First, there are four discussions regarding the position of BPI Danantara in the Indonesian constitutional structure. First, the establishment of BPI Danantara shows that Indonesia has adapted and combined various institutional models of sovereign wealth funds from other countries with adjustments to the national constitutional context. Second, the establishment of BPI Danantara reflects the separation of functional powers and the institutionalization of specific functions within state institutions. Third, the establishment of BPI Danantara indicates a shift in the state's institutional paradigm in the field of state-owned enterprises from a government bureaucracy paradigm to a business and corporate paradigm. Fourth, BPI Danantara is a sui generis auxiliary state organ established to manage the Indonesian government's sovereign wealth fund through a holding company structure. Second, strengthening the position of BPI Danantara in the Indonesian constitutional structure is pursued through three recommendations. First, strengthening the legal basis for the establishment of BPI Danantara. Second, strengthening adequate and structured supervision of BPI Danantara. Third, strengthening the legal accountability of BPI Danantara.
