Restrukturisasi Peran SUBDIT Kepelautan DITKAPEL DJPL KEMENHUB Dalam Rangka Optimalisasi Pemberian Perlindungan Bagi Pelaut

      Penelitian ini mengkaji ketidakpastian perlindungan hukum pelaut Indonesia akibat paralelisme rezim pelayaran di bawah Kementerian Perhubungan dan rezim pelindungan pekerja migran berdasarkan Undang-Undang Nomor 18 Tahun 2017, yang diperparah oleh tidak jelasnya mandat Subdirektorat Kepelautan pascareformasi birokrasi, sehingga menegaskan urgensi restrukturisasi kelembagaan dalam kerangka hukum pelayaran sebagai lex specialis yang selaras dengan standar internasional. Hal ini memunculkan rumusan permasalahan yang diangkat oleh penulis, yaitu (i) implikasi status quo peran subdirektorat kepelautan terhadap perlindungan hukum pelaut Indonesia dan (ii) restrukturisasi peran subdirektorat kepelautan untuk meningkatkan perlindungan pelaut.

      Penelitian ini menggunakan metode hukum normatif deskriptif-analitis dengan analisis kualitatif terhadap bahan hukum nasional dan internasional di bidang pelayaran, didukung studi kepustakaan, observasi kebijakan, dan wawancara terbatas, melalui pendekatan perundang-undangan, konseptual, dan historis untuk menilai tumpang tindih kewenangan serta penerapan asas lex specialis dalam perlindungan hukum pelaut Indonesia.

      Penelitian ini memiliki Kesimpulan: Pertama, implikasi status quo peran Subdirektorat Kepelautan terhadap perlindungan hukum pelaut Indonesia menimbulkan 4 masalah, yaitu tidak adanya mandat perlindungan hukum pelaut pada Subdirektorat Kepelautan; timbulnya keterbatasan jenis kegiatan jabatan Subdirektorat Kepelautan; tidak adanya kewenangan pengawasan agen awak kapal; dan belum terinternalisasinya kewajiban Maritime Labour Convention 2006 dalam struktur DJPL. Kedua, restrukturisasi peran Subdirektorat Kepelautan melalui pembentukan unit fungsional perlindungan pelaut (SPWU/PPKP) merupakan langkah normatif-operasional yang sah dalam kerangka PM Perhubungan Nomor 4 Tahun 2025 untuk mengoperasionalkan mandat perlindungan pelaut, menyelaraskan kewajiban hukum negara dengan desain kelembagaan pelayaran nasional, serta memperkuat pelaksanaan rezim hukum pelayaran sebagai lex specialis dan reputasi Indonesia dalam tata kelola ketenagakerjaan maritim global.


      This research examines the legal uncertainty surrounding the protection of Indonesian seafarers arising from the parallelism between the maritime regulatory regime under the Ministry of Transportation and the migrant worker protection regime governed by Law Number 18 of 2017, a condition further exacerbated by the ambiguous mandate of the Subdirectorate of Seafaring following bureaucratic reform. This situation underscores the urgency of institutional restructuring within the maritime legal framework as a lex specialis aligned with international standards. Accordingly, this study formulates two main research questions: (i) the implications of the status quo role of the Subdirectorate of Seafaring on the legal protection of Indonesian seafarers, and (ii) the restructuring of the Subdirectorate's role to enhance seafarer protection.

      This study employs a normative-empirical legal research method with a descriptive approach. The data collected includes secondary data obtained from primary and secondary legal materials, and primary data gathered through interviews with respondents and key informants using interview guidelines. The collected data is then analyzed qualitatively.

      The study concludes as follows. First, the status quo role of the Subdirectorate of Seafaring in relation to the legal protection of Indonesian seafarers gives rise to four principal issues: the absence of an explicit mandate for seafarer legal protection within the Subdirectorate; limitations on the scope of its functional activities; the lack of supervisory authority over crew recruitment and placement agencies; and the insufficient internalization of the obligations of the Maritime Labour Convention, 2006 within the organizational structure of the Directorate General of Sea Transportation. Second, restructuring the role of the Subdirectorate of Seafaring through the establishment of a functional unit for seafarer protection (SPWU/PPKP) constitutes a legitimate normative-operational measure within the framework of Minister of Transportation Regulation Number 4 of 2025. Such restructuring serves to operationalize the state's legal obligations for seafarer protection, align institutional design with national maritime governance, strengthen the implementation of the maritime legal regime as a lex specialis, and enhance Indonesia's reputation in global maritime labor governance.
