Penelitian ini mengkaji Problematika Pemenuhan Hak Ekonomi, Sosial Dan Budaya Negara Subjek Calling Visa. Tujuan penelitian adalah menganalisis dan menjelaskan problematika dari pemenuhan hak ekonomi, sosial dan budaya negara subjek calling visa, serta mengidentifikasi dan merumuskan solusi strategis yang dapat dilakukan oleh Direktorat Jenderal Imigrasi dalam mengatasi problematika dari pemenuhan hak ekonomi, sosial dan budaya negara subjek calling visa.

Penelitian ini merupakan penelitian hukum normatif-empiris. Cara memperoleh data primer dari Direktorat Jenderal Imigrasi, sedangkan data sekunder diperoleh melalui penelitian kepustakaan. Metode pendekatan masalah yang digunakan yaitu pendekatan perundang-undangan, pendekatan perbandingan hukum, dan pendekatan konseptual. Analisis data menggunakan metode kualitatif, disajikan secara deskriptif analitis, dan metode penarikan kesimpulan dilakukan secara induktif.

Penelitian ini memiliki kesimpulan: Pertama, Implikasi kebijakan ini mencakup tingginya angka pelanggaran keimigrasian oleh warga negara subjek calling visa pada tahun 2024, serta lemahnya peran penjamin dalam memverifikasi profil dan dokumen orang asing yang memicu risiko salah sasaran pemberian visa. Kedua, Solusi strategis mencakup pembaruan mekanisme clearance house melalui verifikasi berbasis profil individu dengan dukungan teknologi AI dan data Interpol, serta penguatan tanggung jawab penjamin melalui regulasi baru yang mencakup sistem kuota, sanksi tegas, dan jaminan finansial (security bond).

This research examines the issues in the fulfillment of the economic, social, and cultural rights of calling visa subject states. The purpose of this research is to analyze and explain the challenges in fulfilling the economic, social, and cultural rights of calling visa subject states, as well as to identify and formulate strategic solutions that can be undertaken by the Directorate General of Immigration to address these challenges.

This study employs a normative-empirical legal research method. Primary data were obtained from the Directorate General of Immigration, while secondary data were gathered through library research. The problem-solving approaches used include the statutory approach, the comparative law approach, and the conceptual approach. Data were analyzed using qualitative methods, presented through descriptive analysis, and conclusions were drawn using an inductive method.

The findings of this research conclude: First, the implications of this policy include a high rate of immigration violations by citizens of calling visa subject countries in 2024, as well as the weak role of guarantors in verifying the profiles and documents of foreign nationals, which increases the risk of misdirected visa issuance. Second, strategic solutions include the renewal of the clearance house mechanism through individual profile-based verification supported by AI technology and Interpol data, as well as strengthening guarantor accountability through new regulations that encompass a quota system, strict sanctions, and the implementation of security bonds.
