IMPLIKASI HUKUM DUALISME FUNGSI TENAGA MEDIS MILITER DALAM IMPLEMENTASI PERATURAN INTERNAL RUMAH SAKIT ANGKATAN UDARA DR. SISWANTO, SOLO

Penelitian ini bertujuan untuk mengetahui dan menganalisis pengaturan Hospital By Laws (HBL) Rumah Sakit Angkatan Udara (RSAU) dr. Siswanto dalam mengakomodasi dualisme peran dan tanggung jawab tenaga medis militer sebagai prajurit Tentara Nasional Indonesia (TNI) sekaligus tenaga kesehatan profesional. Selain itu, penelitian ini juga bertujuan untuk mengetahui dan menganalisis implikasi hukum dari dualisme fungsi tenaga medis militer terhadap pelaksanaan standar pelayanan kesehatan di RSAU dr. Siswanto.

Penelitian ini merupakan penelitian yuridis empiris, yaitu penelitian yang

mengkaji ketentuan normatif di dalam perundang-undangan yang berlaku di Indonesia diwujudkan senyatanya. Lokasi penelitian di Rumah Sakit Angkatan Udara (RSAU) dr. Siswanto, Solo. Bahan penelitian terdiri dari data sekunder dan data primer. Data sekunder diperoleh melalui studi dokumen, sedangkan data primer diperoleh melalui wawancara dengan subyek penelitian. Kedua data selanjutnya dianalisis secara kualitatif dengan penarikan kesimpulan secara deduktif.

Hasil penelitian menunjukkan bahwa; 1) pengaturan HBL RSAU dr. Siswanto Solo belum sepenuhnya mampu mengakomodasi dualisme peran tenaga medis militer secara optimal karena kedudukannya yang subordinatif terhadap sistem komando dan belum adanya pengaturan eksplisit mengenai batas kewenangan klinis; 2) dualisme fungsi tersebut menimbulkan implikasi hukum berupa pembatasan otonomi klinis, potensi ketidaksetaraan pelayanan, gangguan keselamatan pasien, serta lemahnya perlindungan hukum preventif bagi tenaga medis dan pasien.

This study aims to identify and analyze the Hospital By Laws (HBL) of the Air Force Hospital dr. Siswanto is accommodating the dualism of the roles and responsibilities of military medical personnel as soldiers of the Indonesian National Armed Forces and professional health workers. In addition, this study also aims to identify and analyze the legal implications of the dualism of military medical personnel's functions on the implementation of health service standards at the Air Force Hospital dr. Siswanto.

This research is empirical legal research, which is research that examines normative provisions in the laws and regulations applicable in Indonesia as they are actually implemented. The location of the research is at the Air Force Hospital dr. Siswanto, Solo. The research materials consist of secondary data and primary data. Secondary data was obtained through document studies, while primary data was obtained through interviews with research subjects. Both data sets were then analyzed qualitatively with deductive conclusions drawn.

The results of the study show that: 1) the Hospital By Laws of the Air Force Hospital dr. Siswanto Solo regulation is not yet fully capable of optimally accommodating the dualism of the military medical personnel's role due to its subordinate position to the command system and the absence of explicit regulations regarding clinical authority limits; 2) this dualism of functions has legal implications in the form of restrictions on clinical autonomy, potential inequality of service, disruption to patient safety, and weak preventive legal protection for medical personnel and patients.
