Pelaksanaan Evaluasi Oleh Pemerintah Pusat Terhadap Peraturan Daerah Kabupaten Konawe Kepulauan Nomor 2 Tahun 2021

Pelaksanaan evaluasi oleh Pemerintah Pusat merupakan sebuah mekanisme krusial untuk memastikan Peraturan Daerah (Perda) selaras dengan peraturan perundang-undangan yang lebih tinggi dan kepentingan umum, terutama pasca Putusan Mahkamah Konstitusi No. 137/PUU-XIII/2015 dan No. 56/PUU-XIV/2016 yang mencabut kewenangan pengawasan represif Pemerintah Pusat. Studi ini menggunakan studi kasus pada Peraturan Daerah Kabupaten Konawe Kepulauan Nomor 2 Tahun 2021 tentang Rencana Tata Ruang Wilayah (RTRW) Tahun 2021-2041, yang kemudian sebagian dibatalkan oleh Mahkamah Agung karena bertentangan dengan Undang-Undang Nomor 27 Tahun 2007 tentang Pengelolaan Wilayah Pesisir dan Pulau-Pulau Kecil. Penelitian ini menggunakan hukum normatif dengan menggunakan pendekatan perundang-undangan (statue approach) dan pendekatan kasus (case approach). Data primer diperoleh melalui wawancara dengan pejabat Kementerian Dalam Negeri dan WALHI Sulawesi Tenggara, sedangkan data sekunder terdiri dari peraturan perundang-undangan, putusan pengadilan, dan literatur lainnya. 

Hasil penelitian tesis ini menemukan bahwa meskipun mekanisme prosedural formal untuk pengawasan preventif oleh Gubernur (sebagai wakil pemerintah pusat) dan Kementerian Dalam Negeri telah diikuti, pengawasan tersebut tidak efektif secara substantif. Para evaluator lalai dan tidak menjalankan asas kecermatan. Bahwa mereka melihat pasal-pasal yang mengizinkan aktivitas pertambangan telah sesuai berdasarkan Undang-Undang Cipta Kerja tetapi mengabaikan larangan spesifik dalam UU No.27/2007 yang secara eksplisit melarang pertambangan di pulau-pulau kecil seperti Wawonni, selain itu Perda ini juga tidak konsisten secara horizontal dengan RTRW Provinsi Sulawesi Tenggara. Lolosnya Perda ini membuat dampak kerusakan bagi lingkungan dan dampak bagi masyarakat. Penguatan yang peneliti rekomendasikan adalah: (1) Menambah indikator terkait evaluasi rancangan Peraturan Daerah, (2) Pembentukan dan Pengembangan SOP untuk evaluasi Rancangan Peraturan Daerah, dan (3) Penguatan Pengawasan vertikal oleh Presiden.

The implementation of evaluation by the central government is a crucial mechanism to ensure local regulations (Perda) are aligned with higher legislation and the public interest, especially following Constitutional Court Decisions Number 137/PUU-XII/2015 and number 56/PUU-XIV/2016, which revoked the central government's repressive supervision authority. This study uses a case study of Konawe Island Regency's local regulation number 2 of 2007 concerning the Regional Spatial Plan (RTRW) for 201-20141. Which subsequently partially annulled by the Supreme Court for conflicting with law number 27 of 2007 concerning the Management of Coastal Areas and Small Islands. This research employs a normative legal method, utilizing a statutory approach and a case approach. Primary date were obtain through interviews with official from Ministry of Home Affairs and WALHI Southeast Sulawesi, while secondary data consist of legislation, court decisions, and other literature.

The findings of this thesis research indicate that although the formal procedural mechanism for preventive oversight by the Governor (as the representative of the Central Government) and the Ministry of Home Affairs were followed, this oversight was not substantively effective, the evaluators were negligent and failed to adhere to the principle of diligence. The saw that the articles permitting mining activities were compliant based on the Job Creation Law but ignored the specific prohibition in law number 27 of 2007, which explicitly bans mining on small islands like Wawonni. Furthermore, the Regional Regulation (Perda) is also horizontally inconsistent with the Southeast Sulawesi Provincial Spatial Plan (RTRW). The passage of this regulation has caused environmental damage and negative impact on the community. The strengthening measures the researcher recommends are: (1) adding indicators related to the evaluation of draft Regional Regulations, (2) established and developing Standard,Operation, Procedures (SOP), for the evaluation of draft Regional Regulations, and (3) Strengthening vertical oversight by the President.
