Akses Presiden terhadap informasi intelijen terutama yang berkaitan dengan urusan internal partai politik, akan dibahas utama dalam penelitian ini. Dilema terletak pada implementasi demokrasi dalam kegiatan Intelijen Negara memberikan informasi intelijen yang meliputi informasi berkaitan dengan urusan internal partai politik kepada Presiden. Terdapat keharusan Badan Intelijen Negara untuk melindungi keamanan nasional dari ancaman dalam aspek politik, namun, penelitian ini akan membahas tentang bagaimana demokrasi dapat dioptimalkan dalam sistem presidensial di Indonesia dengan upaya check and balances dalam pelaporan intelijen terkait hal internal partai politik yang diberikan oleh Badan Intelijen Negara kepada Presiden. Penelitian ini akan dilakukan dengan pendekatan normatif, dengan memeriksa undang-undang dan peraturan terkait yang mengatur masalah intelijen negara. Check and balances sebagai elemen dari demokrasi menjadi upaya untuk mengoptimalkan sistem presidensial di Indonesia dalam hal pelaporan informasi intelijen negara dari Badan Intelijen Negara kepada Presiden.

The access of the President towards intelligence information especially in regards to internal matters of a political party will be mainly discussed in this research. The dilemma lies within the implementation of democracy within the activity of the State Intelligence providing intelligence information in regards to internal matters of a political party to the President. There is a necessity of the State Intelligence Agency to protect national security from threats such as in the aspect of politics, however, this research will discuss on how democracy can be optimized within the presidential system in Indonesia by the effort of check and balances in the intelligence report in regards to internal matters of a political party provided by the State Intelligence Agency to the President. This research will be conducted by a normative approach, with examining relevant laws and regulations that governs the matters of state intelligence. Check and balances as an element of democracy is the way to optimize the presidential system in Indonesia in terms of state intelligence report from the State Intelligence Agency to the President.
