Pelindungan Hukum Terhadap Pekerja Perempuan yang Bekerja pada Malam Hari (Studi Kasus Jogja Billiard Pool Hall)

This study is motivated by the growth of new businesses in Yogyakarta’s nightlife sector after the Covid-19 pandemic, including Jogja Billiard Pool Hall. Jogja Billiard Pool Hall is one of the billiard halls in Yogyakarta that employs female workers on night shifts (23:00–07:00). This study aims to identify and analyse the forms of legal protection provided to female workers working night shifts at Jogja Billiard Pool Hall.
It employs a normative-empirical research type with a descriptive character. Secondary data were obtained from literature studies in the form of primary and secondary legal materials. In addition, primary data were gathered through interviews with informants and respondents in the field. All collected data were analysed qualitatively and presented descriptively.
The findings reveal a discrepancy between the written regulations and their implementation in the field. Female workers working night shifts at Jogja Billiard Pool Hall have not fully received their rights as mandated by Law No. 13 of 2003 concerning Manpower. This condition is caused by the company’s limitations in fulfilling the rights of female workers, compounded by a lack of understanding from both employers and female workers regarding the provisions on labour protection. Additionally, inadequate supervision and insufficient post-supervision evaluation by the government have contributed to the stagnation of legal protection implementation for female night shift workers.
