Perlindungan hukum terhadap Microsoft Software yang digunakan oleh Warnet yang mengandung unsur komersial di Kabupaten Sleman

Tujuan dari penelitian ini adalah untuk mengetahui sejauh mana UUHC No 19 tahun 2002 mengenai pembajakan hak cipta, dipatuhi oleh para pengusaha warnet yang menggunakan Microsoft software dalam warnet mereka di Kabupaten Sleman dan penegakkan hukum macam apa yang dilaksanakan oleh pihak yang berwenang yaitu Polisi dan PPNS untuk menegakkan peraturan perundangan ini. Penelitian mengenai perlindungan hukum terhadap Microsoft software yang digunakan oleh warnet yang mengandung unsur komersial di Kabupaten Sleman merupakan penelitian hukum empiris yaitu penelitian lapangan yang diperkuat dengan penelitian kepustakaan. Data yang diperoleh adalah data primer dan data sekundur, data primer didapatkan melalui penelitian lapangan dengan membagikan kuisioner kepada pengusaha warnet di Kabupaten Sleman, dan melakukan wawancara dengan responden dan narasumber. Sedangkan data sekunder yang diperoleh dari bahan hukum primer, sekunder dan tersier yang diperoleh melalui penelitian kepustakaan. Penelitian ini menggunakan metode non-random sampling artinya tidak semua populasi diberikan sekempatan menjadi sampel, sedangkan teknik pengambilan sampel menggunakan metode purposive sampling. Hasil penelitian menunjukkan bahwa masih banyak warnet yang ada di Kabupaten Sleman yang menggunakan Microsoft software bajakan dan tindakan yang diambil oleh aparat penegak hukum yaitu Polisi dan PPNS masih dalam bentuk sosialisasi dan pemantauan di dalam masyarakat bahwa menggunakan Microsoft Software bajakan adalah suatu hal yang melanggar hukum. Baik kedua aparat penegak hukum ini, sejauh ini mengambil tindakan yang bersifat preventif belum bersifat represif. Dari analisis tersebut diperoleh jawaban bahwa penggunaan Microsoft software bajakan dalam warnet di Kabupaten Sleman telah melanggar aturan HKI yaitu UUHC No. 19 tahun 2002 dan karakteristik perlindungan yang diberikan oleh hukum, yang dilaksanakan oleh Polisi dan PPNS masih bersifat preventif.

The aim of this research is to know how far of the implementation of Copyrights Act number 19 / 2002, specially in piracy of copyrights, obeyed by the owner of internet cafes that used Microsoft software in their internet cafes at Sleman Regency and what kind of law enforcement that being held by the Police and PPNS (Civil Government Investigate Officer) to enforce this regulation. This research on the protection of law toward Microsoft software that being used in Internet cafes and what kind of action that have taken by the police and PPNS to uphold this regulation is juridical empirical research that is a field research strengthened with bibliography research. The obtained data are primary and secondary data. Primary data were obtained from field research by distributing questioners to the owners of Internet cafes at Sleman Regency, and conducted interviews with respondents and source person. Meanwhile, secondary data were obtained from the substance of the primary, secondary, and tertiary law through library research. This research used non-random sampling method that is, not all population were given chance to be the sample, while the technique of sample intake was purposive sampling method. The results of research shows that many internet cafes at Sleman Regency still using the piracy version of Microsoft software and the act that being taken by the Police and PPNS as the law enforcement are still in the form of socialization and conduct an observation in the community that using the piracy version of Microsoft software is against the law. And both the Police and PPNS so far are taking the preventive kind of action, yet of the repressive ones. Based on this analysis, the used of Microsoft software the piracy version in the internet cafes at Sleman Regency are against the regulation of Intellectual Property Rights which is UUHC No. 19 / 2002. And the characteristic of protection given by law, which carried out by the Police and PPNS are the preventive ones.
