Pergeseran Konsep Kekhususan Ibu Kota Negara: Studi DKI Jakarta dan Ibu Kota Nusantara

Presiden telah mengambil kebijakan mengenai pemindahan ibu kota negara dari Provinsi DKI Jakarta ke IKN. Namun, kekhususan yang diberikan kepada IKN tidak sama dengan kekhususan di Provinsi DKI Jakarta, sehingga kekhususan IKN menimbulkan perdebatan atau celah hukum. Penelitian ini mempunyai dua rumusan masalah. Pertama, apa pergeseran konsep kekhususan yang terjadi antara DKI Jakarta dan IKN? Kedua, apa implikasi pergeseran konsep kekhususan antara DKI Jakarta dan IKN terhadap hubungan pusat dan daerah? Penelitian ini termasuk ke dalam jenis penelitian hukum normatif yang menggunakan pendekatan undang-undang, pendekatan historis, dan juga pendekatan konseptual. Hasil penelitian ini menunjukkan terjadi pergeseran kekhususan antara DKI Jakarta dan IKN, yang dapat dilihat dari beberapa aspek, yaitu pergeseran pemimpin daerah, metode pemilihan, dan juga keberadaan DPRD, selanjutnya pergeseran definisi, konsep dan bentuk pemerintahan daerah, pergeseran konsep ibu kota negara dan perbandingan pengaturan ibu kota NKRI dengan negara lain. Implikasi konseptual dari pergeseran kekhususan antara DKI Jakarta dan IKN terhadap hubungan pusat dan daerah, dapat dilihat dari beberapa aspek, meliputi asas yang berbeda dalam penyelenggaraan pemerintahan daerah, hubungan pusat-daerah yang berbeda antara DKI Jakarta dan IKN serta ketidaksesuaian dengan teori desentralisasi asimetris. Pemerintah pusat perlu mempertimbangkan kembali bentuk pemerintahan yang akan diterapkan di IKN serta mengubah ataupun mengganti UU No. 3 Tahun 2022 tentang Ibu Kota Negara beserta perubahannya disesuaikan dengan pilihan yang telah ditetapkan.

The president has made a policy to relocate the country capital from DKI Jakarta Province to the Capital of Nusantara. However, specificity accorded to the Capital of Nusantara differs from that of DKI Jakarta, giving rise to debates and legal uncertainties. This research has two problem formulations. First, what is the shift specificity concept that occurs between DKI Jakarta and the Capital of Nusantara? Second, what are the implications of shift specificity concept between DKI Jakarta and the Capital of Nusantara on the central and regional relationship. This research is normative legal research that uses statutory approach, historical approach, and conceptual approach. The result of this research indicate there is shift in specificity concept between DKI Jakarta and the Capital of Nusantara, can be seen from several aspects, namely shift regional leaders, election methods, existence of the Regional People’s Representative Council, shift in definitions, concepts and forms regional government, shift concept country capital and comparative regulation of capital in the Unitary State of Republic Indonesia with other countries. Shift in specificity concept between DKI Jakarta and the Capital of Nusantara has implications for the relationship between the central and regional, can be seen from several aspects, namely different principle in regional governance, different central and regional relationships between DKI Jakarta and the Capital of Nusantara, and uncomformity with asymmetric decentralization theory. Central government needs to reconsider the form of government that will be applied in the Capital of Nusantara and amend or replace Law Number 3 of 2022 concerning the Country Capital along with its amendments, adjusted to the chosen option.
