PELINDUNGAN HUKUM PENYANDANG DISABILITAS YANG BEKERJA DI SEKTOR INFORMAL TERHADAP AKSES JAMINAN SOSIAL KETENAGAKERJAAN (Studi Kasus Di Provinsi DKI Jakarta)

Tujuan dari penelitian ini adalah untuk mengetahui dan menganalisis asas kepastian hukum dalam ketentuan Pasal 26 Peraturan Daerah Nomor 4 Tahun 2022 tentang Pelaksanaan Penghormatan, Pelindungan, dan Pemenuhan Hak Penyandang Disabilitas serta dinamika pelindungan hukum preventif bagi penyandang disabilitas yang bekerja di sektor informal terhadap jaminan sosial ketenagakerjaan.

Penelitian ini merupakan berjenis penelitian normatif dan bersifat deskriptif. Penelitian normatif dilakukan melalui studi dokumen untuk memperoleh data sekunder dengan bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier serta didukung wawancara narasumber. Hasil penelitian ini selanjutnya dianalisis secara kualitatif dan dipaparkan secara deskriptif.

Hasil penelitian menunjukan bahwa Pasal 26 Peraturan Daerah Nomor 4 Tahun 2022 tentang Pelaksanaan Penghormatan, Pelindungan, dan Pemenuhan Hak Penyandang Disabilitas belum memberikan kepastian hukum dan dinamika pelindungan hukum secara hukum positif telah tersedia instrumen hukum yang memadai sebagai pelindungan hukum preventif, tetapi dalam praktiknya penyandang disabilitas yang bekerja di sektor informal masih menghadapi berbagai hambatan dan tantangan dalam memperoleh jaminan sosial ketenagakerjaan, seperti adanya kekosongan hukum yang berdampak pada tidak adanya kepastian hukum.

The purpose of this study is to determine and analyze the principle of legal certainty in the provisions of Article 26 of Regional Regulation Number 4 of 2022 concerning the Implementation of Respect, Protection, and Fulfillment of the Rights of Persons with Disabilities and the dynamics of preventive legal protection for persons with disabilities working in the informal sector regarding employment social security.

This research is a normative research and is descriptive in nature. Normative research is conducted through document studies to obtain secondary data with primary legal materials, secondary legal materials and tertiary legal materials and supported by interviews with informants. The results of this study are then analyzed qualitatively and presented descriptively.

The results of the study show that Article 26 of Regional Regulation Number 4 of 2022 concerning the Implementation of Respect, Protection, and Fulfillment of the Rights of Persons with Disabilities has not provided legal certainty for persons with disabilities and the dynamics of legal protection in positive law have provided adequate legal instruments as preventive legal protection, but in practice, persons with disabilities who work in the informal sector still face various obstacles and challenges in obtaining employment social security, such as the existence of a legal vacuum which has an impact on the absence of legal certainty.
