Penulisan
hukum ini bertujuan untuk mengetahui dan
menganalisis keabsahan hak WNI keturunan Tionghoa selaku pemilik asal (trustor)
atas tanah objek perjanjian pinjam nama (nominee agreement) di wilayah
Daerah Istimewa Yogyakarta (DIY), serta menganalisis pelindungan hukum ahli waris yang sah dari trustor
terhadap kepemilikan hak atas tanah warisan yang merupakan objek perjanjian
pinjam nama.
Jenis dari penelitian hukum ini adalah yuridis-normatif atau doktrinal
yang didukung dengan hasil wawancara dari narasumber. Penelitian ini
bersifat deskriptif-analitis dengan menyajikan analisis
terhadap permasalahan dan pelaksanaan hukum dalam putusan. Penelitian
dilaksanakan melalui studi kepustakaan guna memperoleh data sekunder yang
mencakup bahan hukum primer, bahan hukum sekunder, serta bahan hukum tersier. Data
yang terkumpul selanjutnya dianalisis secara kualitatif dan disajikan secara deskriptif-analitis.
This
legal research aims to identify and analyze the validity of the rights of
Indonesian citizens of Chinese descent as the original owner (trustor) of land
subject to a nominee agreement in the Special Region of Yogyakarta (DIY), as
well as to examine the legal protection of the trustor’s legitimate heirs over
inherited land rights that are the object of such an agreement.
This
research adopts a juridical-normative or doctrinal method, supported by
interviews with selected informants. This research is descriptive-analytical in
nature, presenting an analysis of legal issues and implementation in court
decisions. The research was conducted through a literature review to obtain
secondary data, including primary legal materials, secondary legal materials,
and tertiary legal materials. The collected data was then analyzed
qualitatively and presented in a descriptive-analytical manner.
The results of the study show that nominee agreements violate the principles of good faith and lawful cause, rendering them null and void as they are intended to circumvent existing legal provisions. Non-indigenous Indonesian citizens, including those of Chinese descent, are restricted from owning freehold land (Hak Milik) in DIY. The use of nominee agreements to evade such restrictions constitutes a form of legal evasion. Under the negative publication system, physical and juridical data contained in land certificates are deemed valid unless proven otherwise. Legal protection mechanisms for heirs become ineffective, as the existence of a nominee agreement serves as a basis for denying the heirs’ rights. The discrepancy between formal and substantive ownership results in the loss of the heirs’ ability to legally defend their interests.
