UPAYA PELINDUNGAN HUKUM HAK CIPTA BATIK OLEH DINAS PERINDUSTRIAN KABUPATEN KUDUS DALAM PELESTARIAN BATIK BAGI PERAJIN BATIK KUDUS

Penulisan hukum ini bertujuan untuk menemukan jawaban dua isu utama pada analisis pelindungan hukum hak cipta batik oleh Dinas Perindustrian Pemerintah Kabupaten Kudus bagi perajin batik Kudus dan penyelesaian hukum atas pelanggaran penjiplakan dan penggandaan motif batik milik Alfa Shoofa Batik Kudus menurut Undang-Undang Hak Cipta Nomor 28 Tahun 2014.

Penelitian ini bersifat deskriptif, artinya untuk memberikan gambaran yang jelas terkait masalah yang dibahas dalam penelitian. Penelitian ini merupakan penelitian normatif yang menggunakan penelitian kepustakaan dan didukung dengan pendapat dari para responden terkait. Peraturan perundang-undangan, buku, jurnal, penelitian, dan literatur lain digunakan untuk melakukan penelitian kepustakaan. Selanjutnya, data yang diperoleh, dianalisis secara kualitatif, disusun, diteliti, dan dipelajari secara menyeluruh.

Hasil penelitian dan pembahasan menunjukkan bahwa terdapat 2 (dua) kesimpulan. Pertama, peran Dinas Perindustrian Pemerintah Kabupaten Kudus berdasarkan Perda Kabupaten Kudus Nomor 3 Tahun 2022 tentang Pengelolaan dan Pelestarian Cagar Budaya belum dilaksanakan secara optimal. Hal ini tercermin dari masih terbatasnya pemahaman tentang hak cipta dan pelindungan hukum hak cipta baik pemerintah maupun para perajin batik Kudus. Kedua, tindakan penjiplakan dan penggandaan ciptaan tanpa izin dari pemilik hak cipta bertentangan dengan ketentuan Pasal 9, Pasal 10, dan Pasal 113 UU Hak Cipta yang secara tegas melarang penggunaan ciptaan untuk tujuan komersial tanpa persetujuan pencipta. Penyelesaian hukum atas pelanggaran berupa penjiplakan dan penggandaan produk batik milik Alfa Shoofa Batik Kudus dengan metode mediasi tertutup. Pilihan ini sejalan dengan ketentuan Pasal 95 UU Hak Cipta yang membuka ruang bagi penyelesaian sengketa melalui alternatif penyelesaian non-litigasi seperti mediasi, negosiasi, atau konsiliasi.

This legal research aims to address two main issue in the legal protection of batik copyrights provided by the Industry Office of the Kudus Regency Government for batik artisans in Kudus, and the legal resolution of copyright infringements involving the imitation and reproduction of batik motifs owned by Alfa Shoofa Batik Kudus, based on Law No. 28 of 2014 on Copyright.

This research is descriptive in nature, aiming to provide a clear overview of the issues discussed. It is a normative legal research that employs literature study and is supported by the opinions of relevant respondents. Statutory regulations, books, journals, previous research, and other literature are used for the literature review. The collected data is analyzed qualitatively, organized, examined, and studied comprehensively.

The results and discussion of the study indicate two main conclusions. First, the role of the Industry Office of the Kudus Regency Government based on Kudus Regional Regulation Number 3 of 2022 concerning the Management and Preservation of Cultural Heritage has not been implemented optimally. This is reflected in the limited understanding of copyright and its legal protection by both the government and batik artisans in Kudus. Second, acts of plagiarism and reproduction of creations without permission from the copyright holder are in violation of Articles 9, 10, and 113 of the Copyright Law, which explicitly prohibit the use of copyrighted works for commercial purposes without the creator's consent. Legal resolution for the infringement involving the unauthorized copying and reproduction of batik products owned by Alfa Shoofa Batik Kudus was carried out through closed-door mediation. This approach aligns with Article 95 of the Copyright Law, which provides space for dispute resolution through alternative non-litigation methods such as mediation, negotiation, or conciliation.
