Extrajudicial Killings and Transitional Justice in Colombia: History, Progress, and Challenges

Skripsi ini menginvestigasi isu pembunuhan extrajudicial yang telah menjadi masalah besar di Kolombia untuk beberapa dekade. Sejak masa kelam La Violencia di Kolombia, pembunuhan extrajudicial telah mengakibatkan hilangnya ribuan nyawa penduduk Kolombia dan merusak hubungan antara negara dan penduduknya. Untuk mengatasi masalah tersebut dan mencapai rekonsiliasi, Kolombia telah menerapkan beberapa mekanisme transitional justice. Akan tetapi, meskipun Kolombia berhasil mendirikan beberapa institusi seperti Comision de la Verdad (Komisi Kebenaran) dan Jurisdiccion Especial para la Paz (Yurisdiksi Spesial untuk Perdamaian), keberhasilan transitional justice di Kolombia masih perlu dipertanyakan. Dengan menggunakan konsep segitiga kekerasan Johan Galtung, skripsi ini memberi observasi analisis mengenai isu kekerasan langsung, struktural, dan kultural yang masih menghantui Kolombia dan membatasi proses transitional justice. Skripsi ini juga menemukan bahwa untuk mengatasi masalah ini sepenuhnya, Kolombia harus menyelesaikan faktor-faktor yang memungkinkan kekerasan dan ketidakadilan untuk terus terjadi di Kolombia.

This thesis investigates the issue of extrajudicial killings that have been a plague in Colombia for decades. Ever since the dark period of Colombia's La Violencia, extrajudicial killings have caused the loss of thousands of Colombian lives and broken the relations between the state and its citizens. To resolve that issue and achieve reconciliation, Colombia has enacted some transitional justice mechanisms in the country. Despite the establishment of some institutions, such as Comision de la Verdad (The Truth Commission) and Jurisdiccion Especial para la Paz (Special Jurisdiction for Peace), the effectiveness of transitional justice in Colombia still leaves much to be desired. Utilizing Johan Galtung's theory of violence triangle, this thesis offers an analytical observation to the issues of direct, structural, and cultural violence that still haunt Colombia and hinder the process of transitional justice. This thesis finds that to fully tackle this issue, Colombia must also address the underlying factors that allow violence and injustices to continuously fester in the country.
