Examining The Application of Lex Specialist Sistematist in The Enforcement of Anti-Corruption Law: A Case Study of Jiwasraya

Penulisan hukum ini membahas mengenai pengaplikasian asas lex specialist systematist dalam kasus korupsi Jiwasraya. Penelitian ini bertujuan untuk: 1) mengetahui serta menganalisis pengaplikasian prinsip lex specialist systematist antara UU Tipikor dan UU Pasar Modal dalam kasus Jiwasraya; 2) mengkaji implikasi atas pengaplikasian UU Tipikor atau UU Pasar Modal dalam kasus Jiwasraya. Penelitian ini berjenis yuridis-normatif dan bersifat deskriptif yang didukung dengan wawancara praktisi hukum. Jenis data yang digunakan adalah data sekunder yang berupa bahan hukum primer dan bahan hukum sekunder yang kemudian dianalisis menggunakan metode kualitatif. Hasil penelitian menunjukan bahwa pengaplikasian UU Tipikor dalam kasus Jiwasraya menunjukan absennya penggunaan asas lex specialist systematist, dengan implikasi merugikan para nasabah namun memberikan keuntungan untuk Negara, maka untuk menanggulangi hal ini penggunaan lex specialist systematist seharusnya diterapkan oleh para penegak hukum.

This Legal Research discusses the application of the lex specialist systematist principle in the corruption case of Jiwasraya. This research aims to: 1) find out and analyse the application of the lex specialist systematist principle between the Anti-Corruption Law and Capital Market Law in the Jiwasraya case; 2) examining the implications of applying the Anti-Corruption Law or Capital Market Law in the Jiwasraya case. This research utilised juridical-normative and descriptive method, supported by interviews with legal practitioners. The type of data used is secondary data in the form of primary legal materials and secondary legal materials which are then analysed using qualitative methods. The results showed that the application of the Anti-Corruption Law in the Jiwasraya case showed the absence of the utilisation of the lex specialist systematist principle, with the implication of harming Jiwasraya clients but provided benefits to the State. Based on this issue, the principle of lex specialist systematist should have been utilised by the law enforcer.
