Penelitian mengenai Aspek Hukum Sistem Administrasi Badan Hukum (SISMINBAKUM) Departemen Kehakiman dan Hak asasi Manusia RI atas Aktaakta Perseroan terbatas dan Pengaruhnya pada Pengembangan Dunia Usaha bertujuan untuk memberi pengetahuan mendalam tentang kajian hukum dari sistem berbasis teknologi internet ini dalam proses pengesahan akta pendirian dan perubahan Perseroan terbatas. Penggunaan SISMINBAKUM ini ditujukan untuk mengatasi kendala proses penggunaan sistem manual, sehingga proses pengesahan tersebut dapat dilaksanakan secara efisien, akurat dan transparan yang diharapkan dapat meningkatkan produktivitas usaha para praktisi bisnis dan menjadi salah satu motivasi bagi para investor untuk menanamkan modal di Indonesia. Penelitian ini bersifat yuridis normatif yaitu meneliti bahan pustaka sebagai data sekunder yang didukung oleh penelitian lapangan melalui pengisian kuisioner dan wawancara terstruktur. Hasil penelitian dianalisis dengan metode kualitatif dan dirangkum dalam laporan yang bersifat deskriptif analisis. Berdasarkan penelitian, penggunaan SISMINBAKUM yang telah dilengkapi dengan security system berupa password dan user id terbukti telah efisien, akurat, transparan dan terjamin kerahasiaannya. Pengesahan akta secara elektronik telah memperoleh kepastian hukum dengan adanya SK Menteri Kehakiman dan Hak Asasi RI No. M-01.HT.01 tahun 2001 sekaligus menunjukkan otentisitas dan keabsahan dokumen sehingga dapat dijadikan alat bukti yang sah di depan pengadilan. Dengan diberlakukannya SISMINBAKUM, minat masyarakat untuk mendirikan PT semakin meningkat. Para pelaku bisnispun akan lebih mantap dan semakin termotivasi untuk mengembangkan usaha serta bekerja sama dengan para investor. Hal ini akhirnya akan menciptakan iklim yang kondusif bagi dunia usaha secara umum.

The research on the legal aspect of legal entity administration system (SISMINBAKUM) of the Department of Justice and Human Rights of the Republic of Indonesia for limited liability company’s acts and its impact for business sector aims to obtain an in-depth knowledge about legal study on the internet-based system in the process of legalization for limited liability company establishment and statuschange acts. The utilization of the SISMINBAKUM is intended to overcome the problems encountered in the process when using manual system, so the legalization process become more efficient, accurate, and transparent, which, in turn, boosts the productivity of business practitioners and becomes one of the motivations for investors to invest their capital in Indonesia. The research is juridical normative, that is, using literatures for secondary data and supported with field research by means of questionnaire and structured interview. Data were analysed qualitatively and the analysis results were presented descriptively and analytically. The research results reveal that the use of the SISMINBAKUM that is equipped with password, and user ID is efficient, accurate, and transparent as well as confidential. Electronic legalization for an act has obtained legal certainty from the Decree of the Minister of Justice and Human Rights of the Republic of Indonesia No. M-01.HT.01/2001, and at the same time proves the authenticity and legality of the document such that it may be used as a legitimate evidence in the court. The implementation of the SISMINBAKUM has accelerated pub lic interests to set up more limited liability companies. Likewise, business practitioners become more confident and motivated to cooperate with investors. It will, in turn, create conducive atmosphere for business sector in general.
