Peranan hukum tua dalam mewujudkan Good Governance di tingkat desa :: Studi di Desa Kamangta Kecamatan Tombulu Kabupaten Minahasa

2004 | Tesis | S2 Ilmu PolitikSebagai Kepala pemerintahan Desa di Kabupaten Minahasa, posisi Hukum Tua memiliki peran mengembangkan penyelenggaraan pemerintahan Desa menjadi lebih baik sesuai ide tentang good governance di tingkat Desa, yakni perbaikan kualitas Pemerintah Desa yang dilakukan secara sinergis antara Hukum Tua, lembaga kemasyarakatan dan warga Desa dengan prinsip: responsif, transparansi, partisipatif, responsibel dan akuntabel. Atas dasar tersebut, penelitian ini bertujuan mencari gambaran mengenai peran dan upaya yang perlu dilakukan agar Hukum Tua Desa Kamangta dapat mewujudkan good governance di tingkat Desa dengan menggunakan analisis data kualitatif. Berdasarkan hasil analisis diketahui bahwa peran Hukum Tua dalam mewujudkan good governance di tingkat Desa belum optimal. Kurangnya peran Hukum Tua Desa Kamangta Kecamatan Tombulu Kabupaten Minahasa dalam mewujudkan good governance di tingkat Desa paling tidak disebabkan oleh 6 (enam) hal : 1) ketidakmampuan dari individu untuk memimpin, 2) kurangnya pengetahuan dan pemahaman Hukum Tua terhadap perubahan peraturan tentang Desa; 3) kurangnya pemahaman konseptual dan operasional Hukum Tua Kamangta mengenai pentingnya kelembagaan eksekutif Desa dalam menjalankan roda pemerintahan; 4) kurangnya tingkat kepedulian masyarakat Desa dalam melakukan kontrol terhadap jalannya pemerintahan Desa; 5) belum jelasnya pengaturan pola hubungan kerja sama antara warga masyarakat dengan lembaga kemasyarakatan dan Hukum Tua dalam penyelenggaraan pemerintahan Desa. 6) kurangnya sosialisasi/pembinaan/ pelatihan yang diterima oleh Hukum Tua/Perangkat Desa/Pimpinan Lembaga dan masyarakat dari Pemerintah Kabupaten. Upaya peningkatan pelaksanaan Good Governance dilakukan dengan menerapkan langkah-langkah strategis internal dan eksternal dalam organisasi pemerintahan Desa. Strategi internal dilakukan oleh Hukum Tua berupa meningkatkan komitmen bersama dan membentuk jaringan kerja sama antara Pemerintah Desa, BPD, Lembaga Kemasyarakatan dan masyarakat. Selanjutnya strategi eksternal dilakukan Pemerintah Kabupaten Minahasa, dalam bentuk kegiatan bersifat politis dimana Pemerintah Desa diberi kewenangan untuk mengatur/mengurus rumah tangganya sendiri tanpa bertentangan dengan ketentuan peraturan yang berlaku, sedangkan yang bersifat teknis, diharapkan Pemerintah Kabupaten dapat memberikan pembekalan untuk peningkatan pengetahuan dan kemampuan teknis penyelenggaraan pemerintahan Desa.
As a head of village level goverment in Minahasa Regency, Hukum Tua has a crucial role in the betterment of village governance implementation in accordance with the basic concept of good governance namely the quality improvement of village level government which is collaboratively conducted by Hukum Tua, societal institutions and villagers, this collaboration is on the ground of responsiviness, transparancy, participation, responsibility, and accountability principles. Departing from this, the study aims at finding out the description and the role of attempt which are needed by Hukum Tua of Kamangta village in implementing good governance in the vilage government level by applying qualitative data analysis. Based on the result of analysis, it is found that the role of Hukum Tua in implementing good governance is not optimum yet. The inability of Hukum Tua Kamangta village in Tombulu district in Minahasa regency in optimizing his role to carry out good governance due to: 1) the lack of leadership quality; 2) the lack of knowledge and understanding of Hukum Tua about the change of regulation concerning the village governance; 3) the lack of conceptual and operational understanding of Hukum Tua Kamangta village the importance of vilage executive institution in running the village governance; 4) the lack of villagers’ participation in controling the village government, 5) the unclearness of management of partnership among villagers, societal institutions and Hukum Tua in running the village goverment; 6) the lack of socialization, control and training of regency governnient toward Hukum Tua/Hukum Tua’s staff7the head of village institution and its main figures. The attempt to improve the implementation of good governance is carried out by employing external and internal strategic steps in village government organization. Internal strategy is praticed by strengthening public commitmen and estabilising good network of village governmenwlIage board of representative, societal flStÃtUtjfl and villagers. External strategy is conducted by Minahasa regency government in the form of political activity in which village government is given authority to manage his own village without neglecting the existing rule and in the form of tehnical activity in which the regency goverment is expected to give training for improvement of knowledge and tehnical ability in the running of village governance.
