PENEGAKAN HUKUM TERHADAP TINDAK PIDANA PENYEBARAN BERITA BOHONG MELALUI MEDIA SOSIAL DI DAERAH ISTIMEWA YOGYAKARTA

Penelitian ini bertujuan untuk mengetahui dan menganalisis problematika yang dihadapi oleh Kepolisian dalam penegakan hukum terhadap tindak pidana penyebaran berita bohong melalui media sosial di Daerah Istimewa yogyakarta. Lebih lanjut, penelitian ini bertujuan untuk mengetahui dan menganalisis upaya yang perlu dilakukan oleh Kepolisian dalam penanggulangan tindak pidana penyebaran berita bohong melalui media sosial di Daerah Istimewa Yogyakarta pada masa yang akan datang. Penelitian ini merupakan penelitian hukum normatif-empiris dengan memperoleh dua data. Pertama adalah data primer yang diperoleh dari hasil wawancara terhadap responden yang berasal dari beberapa penyidik bidang siber pada beberapa wilayah hukum di bawah Kepolisian Daerah Istimewa Yogyakarta yang memiliki pengetahuan terkait norma hukum penyebaran berita bohong di Indonesia. Kedua adalah data sekunder dengan adanya bahan hukum primer, bahan hukum sekunder, dan bahan hukum tersier. Penelitian ini juga bersifat deskriptif dan memiliki bentuk penelitian preskriptif. Hasil penelitian ini memperoleh dua kesimpulan dengan dianalisis melalui teori sistem hukum. Pertama, problematika yang ada, yakni seperti adanya volume

dan kecepatan penyebaran informasi, keterbatasan sumber daya dan tenaga ahli, kendala regulasi dalam ketentuan peraturan perundang-undangan, privasi dan kebebasan berpendapat, anonymity dan kesulitan dalam mengidentifikasi pelaku, efek sosial dan politik dari penyebaran hoaks, dan kesadaran publik yang rendah/minim akan validitas informasi. Kedua, pentingnya kebutuhan dan upaya yang harus dilakukan oleh kepolisian dengan cara penguatan kapasitas cyber patrol dan sistem deteksi dini, kerja sama dengan platform media sosial dan penyedia layanan internet (ISP), pengembangan kemampuan digital dan teknologi sumber daya manusia (SDM), edukasi dan kampanye literasi digital untuk masyarakat, pembentukan tim khusus penanganan hoaks dengan pendekatan restoratif, penguatan sistem layanan pelaporan publik, penyusunan dan penyelarasan aturan internal dalam penegakan hukum, dan penelitian dan pengembangan untuk memahami dinamika hoaks.

This study aims to determine and analyse the problems faced by the Police in enforcing the law against the crime of spreading fake news through social media in the Special Region of Yogyakarta. Furthermore, this study aims to determine and analyse the efforts that need to be made by the Police in overcoming the crime of spreading fake news through social media in the Special Region of Yogyakarta in the future. This research is a normative-empirical through two data. The first is primary data obtained from interview techniques with respondents from several cyber investigators in several jurisdictions under the Yogyakarta Special Region Police and sources who have knowledge related to the legal norms of spreading fake news in Indonesia. The second is secondary data using primary legal materials, secondary legal materials, and tertiary legal materials. This research is also descriptive and has a prescriptive research form. The results of this study obtained two conclusions which analyse with legal system. First, the existing problems, such as the volume and speed of information dissemination, limited resources and experts, regulatory constraints in the provisions of laws and regulations, privacy and freedom of speech, anonymity and difficulty in identifying perpetrators, the social and political effects of the spread of hoaxes, and low/minimal public awareness of the validity of information. Second, the importance of the needs and efforts that must be made by the police by strengthening the capacity of cyber patrols and early detection systems, cooperation with social media platforms and internet service providers (ISPs), development of digital and technological capabilities of human resources (HR), education and digital literacy campaigns for the community, formation of a special team for handling hoaxes with a restorative approach, strengthening the public reporting service system, drafting and aligning internal regulations in law enforcement, and research and development to understand the dynamics of hoaxes.
